Award a construction contract to Dawson-Mauldin Construction, Inc., of Huntington Beach, California in the amount of $2,169,958 for the Browning and Palm Water Main Replacements and Transfers Bid File - 3261 RECOMMENDATIONS Staff recommends that City Council: 1. Adopt finding of Categorical Exemption, pursuant to the provisions of Section 15301(b) of the (CEQA) Guidelines. 2. Award a construction contract to Dawson-Mauldin Construction, Inc. of Huntington Beach, California in the amount of $2,169,958 for the construction of the Browning and Palm Water Main Replacements and Transfers. EXECUTIVE SUMMARY The proposed water main replacements will allow the installation of water services to the front of the properties located in the Browning and Palm neighborhoods, allowing the connection of water meters, while also upgrading water mains installed in the 1950's. The new services will be installed within the street right-of-way improving access for staff. REPORT TO THE CITY COUNCIL Award Construction Contract to Dawson-Mauldin Construction, Inc. for construction of the Browning & Palm Water Main Replacements & Transfers May 1, 2014 Page 2 BACKGROUND The proposed project consists of water main replacement including the installation of new water services in the Browning and Palm area located within the City of Fresno and Fresno County. The Browning and Palm project area is generally bordered by Bullard Avenue, Barstow Avenue, Farris Avenue and Maroa Avenue. Existing water mains are located in backyard easements of the properties and provide limited access for City maintenance staff. These mains are more than 50 years old and are nearing the end of their service life. The proposed project will install new water mains and services within the street right-of-way improving access for staff. In accordance with AO 6-19 Public Works advertised and hired a Consultant for the design of plans and general construction documents for the Browning and Palm Water Main Replacements and Transfers. The Notice Inviting Bids was published in the Business Journal on February 3, 2014, posted on the City's website and faxed to ten (10) building exchanges. The specifications were distributed to six (6) prospective bidders. Seven (7) sealed bid proposals were received and opened in a public bid opening on February 25, 2014 with the bids ranging from $2,169,958 to $3,557,360. Bids were posted on April 11, 2014 and a bid appeal was received on April 11, 2014. The bid appeal along with the determination of the Purchasing Department, to deny the request for an appeal hearing, was forwarded to the City Attorney's Office on April 16, 2014 for review. The determination, as amended and approved by the City Attorney's Office on April 23, 2014, was sent to the appellant contractor on April 24, 2014. Staff has determined that Dawson-Mauldin Construction, Inc. is the lowest responsive and responsible bidder. Therefore, staff is recommending award of a construction contract to Dawson- Mauldin Construction, Inc. of Huntington Beach, California in the amount of $2,169,958 for the construction of the Browning and Palm Water Main Replacements and Transfers, and authorize the Public Works Director, or his designee, to sign the standardized contract for the City of Fresno. ENVIRONMENTAL FINDINGS Staff has determined that a Categorical Exemption is appropriate, based on Class 1 Section 15301(b) of the CEQA Guidelines, which exempts the repair, maintenance, or minor alteration of existing facilities of publicly-owned utilities used to provide electric power, natural gas, sewerage or other public utility services, because the project is replacing existing water services with no expansion of existing use. Furthermore, Staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2 apply to this project. Staff recommends that the Council, based upon its own independent judgment, adopt finding of a Categorical Exemption per staff determination, pursuant to Section 15301(b), Class 1 of the CEQA guidelines for the Browning and Palm Water Main Replacements and Transfers project. FISCAL IMPACT This project is identified in the five year Capital Improvement Plan and funding was included in the FY 2014 Water Enterprise Fund (40101).
