RESOLUTION NO. 82-577
A RESOLUTION OF THE COUNCIL OF THE CI'rY
OF FRESNO, CALIFORNIA, ACCEPTING DEED
OF CONSERVATION EASEMENT
hTI-IEREAS I it is the desire of the Council o:.t: the City
of Fresno, California, to encourage the preservettion of
historically si9nif icant properties lc,cated within the
City; and
Development
WHEREAS, the Council has adopted an historic preservation
element of the 1974 Fresno-Clovis ME:\tropolitan Ar,ea General
Plan encouraging the pre~;ervation of historically significant
properties; and
WHEREAS., the Council has adopted the Historic Preserv·ation
Ordinance of the City of Fresno in an attempt to assist i1:1,
the preservation and recognition of h.:i.storic structures
located within the City of Fresno; and
WHEREAS, the Council is especially desirous of havin9
historic structures presierved without the need to expend
pillblic funds for acquisition and maint~enanCe of i;uch
structures; and
WHEREAS, the Brix Home, also commonly known as the
American National Red Cross Building, located at 2844 Fresno
Street, was constructed in 1911 by He:tman Brix" and is the
work of Edward Foulkes, Architect, ancl is an outstanding
example of the !tali.an vj_lla style of architecture and
constructioni and
Vi.-711:EREAS, the owners of the Brix Home are desirous to
grant an easement to the City of Fresr.10 for purposes of
conservation of the scenic beauty and architecture of i::he
Brix Home; and

WHEREAS, the owners <):E the prope:rty have prepared
and executed sttch an easement in favor of the City of
Fresno as Grantee and have requested that the City of
Fresno accept such easem,ant; and
WHEREAS, Sections 815 to 816 of the California Civil
Code encourage and provide for the grant of conservation.
easements and authorize cities to ac(:ept such interests.,
NOW, THEREFORE, BE IT RESOLVED i;::.hat the Cot1ncil of the
City of Fresno does hereby accept th•e easement dated
December 21 , 1982, granting to thie City of Fresno an --·••
easement for scenic, conservation, and architectural facatde
preservation purposes upon the Brix Home.
BE IT FURTH:E:R RESOLVED that the Chief Adtninistrati,re
Officer and the Director of the Department of Developme11t
are authori2:ed to execut.e the acceptance of said
easeme11t on behalf of the City of F:eesno,#
