RESOLUTION NO. 82 -57:~
RESOLUTION OF 'l!HE COUNCIL OF 'l'HE CITY OF
FRES~O APPLYING TO THE FRESNO LOCAL AGiENCY
FORMATION COMMISSION IN THE MATTER OF THE
PROPOSED CLINTON-MARKS NO,. 4-B DISTRICT ~EORGAN-
IZATION, INCLUDING TH:El DETACHMENT OF CERTAIN
TERRITORY CONSISTING OF 135 .. 60 ACRES FROM
THE NORTH CENTRAL FIRB PROTECTION DISTRICT
AND FROM THE KINGS RIVER CONSERVATION DIS-
TRICT AND ANNEXATION OF THE SAME! TERRITORY
TO THE CITY OF FRESNO.
WHEREAS, this proposal is 111ade pursuant to the District
Reorganization Act of 1965 contclined in Division l of Title
6 (commencing with Sec~tion 56000) of the California. Gove:rn-
ment Code; and
' WHEREAS, the nature of the proposed change is a reo:rgan-
izat:Lon consisting of the detachment of certain territory
consisting of 135.60 acres and hereinafter called the
"subject territor~r" from the North Central Fire Protection
District and from the Kings Ri V{?-r Conservation District,
and annexation of the same territory to the City of Fresno;
and
WHEREAS, no other counties, ,~ities,. or districts are
affected; and
WHEREAS, the proposed reorga:nization is-·inhabited,
is described in Exhibit "A", and ,graphically depicted in
Exhibit "B"; and
WHEREAS, no new districts are proposed to be formed
by this reorganization; and
WHEREAS, the Fresno County Assessor's roll will be
used fo:r:-the purpose of levying any asse:s~~ments or taxes
on the subject territory; and
WHEREAS, the subject territory proposed to be annexed
to the City of Fresno will be exempted from taxation for the
payment of principal or interest, or any other amounts
which sh.all becom,a due on, account of any outstanding bonded
indebtedness incurred by the City prior to the effective date
of such annexation and upon completion of this reorganization

proposal the subject territory will be included in Municipal
Bond Area 0 n 11 and will not be taxed for any existing bonded
indebtedness or contractual obligations; and
WHEREAS, the reasons for this proposal are stated af;
follows:
1. Annexation of the sub:ject territory to the
Cit.y of Fresno will result in improved land
use planning. All private development con-
trols of the City will apply, following
reorganization ..
2. This project is in re.sponse to a LAFCO condition
of approval applied to the Shields-Brawley No. 2
District Reorganizaticm." whereby recordatian of
said Shields-Brawley No .. 2 would be held in abey-
ance pending initiation of an annexation proposal
for the subject territory.
3. The subject territory is within the City of
Fresno's Sphere of Influence.
4 .. :rt ,is advantageous for the terri to;ry within
the Clinton-Marks No.. 4-B Dist1::-ict Reorganization
to be a part of the City.
NOW t IJ:HEREFORE I BE IT RESOLVED that the Council of the
City of Fre~sno hereby requests that proceedings be taken by
the Fresno Local Agency Formation Commission for the herein
proposed Clinton-Marks No. 4-B District Rec1rganization, includ-
ing the detachment of the subject territory·, consisting of
135 .. 6 O ac:irE~s from the North Central Fire Protection Dis-
trict and from the I<ings River Conservation District, and
annexation of the same territory to the City of Fresno.
BE IT'FURTHER RESOLVED:
1. Staff is directed to prepare a:nd proces:s; an
E;nvironmental assessment pursuant to th(a pro-
'.idsions of the California Environmental Quality
Act and Article 5 of Chapber 12 of the.Fresno

~iunicipal Code, relating to this reorganization

2. Staff is directed to prepare and process a ser-
vice plan, pursuant to Government Code Section
35102 a;nd the rules <:>f the Fresno County Local
Agency Formation Commission, for the subject
terri t.ory.
3. Staff is directed to submit and file the com-
pleted environmental assessment, s 1ervice plan,
this resolution, and all related o:r necess.ary
docume:nts, with the Fresno Local Agency Forma-
tion Commission ..
4~ Staff is directed to mail an informational meeting
notice to all property owners within the subject
territory to schedule a neighborhood meeting, to
explain the ramifications of annexation upon the
submission and filing of this resolution with the
Fresno Local Agency Formation Commission.
