HomeMy WebLinkAboutResolution - City Council - 82-571 - 1982-12-21I RESOLUTION NO. 82-571 RESOLUTION OF THE COUNCIJ~ OF THE CITY OF FRESNO APPLYING TO THE FRESNO LOCAL AGENCY FORMATION COMMISSION IN THE MAT~1ER OF THE PROPOSED J'ENSEN- CHES'IjNUT NO. 4 DISTRICT REORGANIZATION, INCLUDING THE DETACHMENT OF CERTAIN TERRITORY CbNSISTING, OF 93.08 ACRES FROM THE MID VALLEY FIRE PROTECTION DISTRICT .AND THE KINGS R:CVER CONSERVA1!'IOlJ DISTRICT, DETACHMENT OF ll 92 .10-ACRE l?ORTION OF THE SUBJECT TERRITORY FROM FRESNO COUNTY SERVICE AREA NO. 18, AND ANNEXATION OF 'l1HE ENTIRE 9 3 .. 0 8 ACRES TO THE CITY OF FRESNO WHEREAS, this proposal is made pursuant to the District \ Reorganization Act of 1965 contained in Division 1 of Title 6 (commencing with Section 56000) of the California Government Code; and WHF:REAS, the nature of the proposed change is a reorgan- ization consisting of the detachment of certain territory consisting of 93.08 acres and hereinafter called the "sub- ject territory" from the Mid Valley Fire Protection District and the Kings River Conservation District, detachment of a 92 -10-acre. portion of the subject ter:ritory from Fresno County Service Area No. 18, and annexation of the entire 93 .. 08 acres to the City of Fresno; and WHEREAS, no other counties, cities, or districts are affected; and WHEREAS, the proposed reorganiz.a tion is inhabited,. is described in Exhibit 0 A" and graphically depicted in Exhibit "Bn; and WHEREAS, pursuant to the requirements set forth in Government Code Section 35102, a service plan for the subject territory has been prepared and is attached hereto as Exhibit nc"; and WHEREAS, review and analysis of Environmental Assessment No. 3957, relating to the California-Maple No. 2--A District Reorganization which incorporates all of the subject territory as a portion of its project area, has been completed a.nd resulted in the filing of a N~gative Declaration by the Director of the Development Department; and Page 1 of 3 WHEREAS, parcelling the larger reo:r:ganization. into several separate proposals will not change the ove:rall en~-rironmental e:Efect of annexing the entire area; and WHEREAS, all envirorunental conoerns pertinent to the Jensen.- Chestnut No. 4 District Reorganization have been addressed by E.A. No. 3957 and no further environmental assessment is necessa1~v; and WHEREAS, no new districts are proposeci to be formed by this reorganization; and WHEREAS, the Fresno County Assessor's roll will be used for the purpose of levying any assessments or taxes on the subject territory; and WHEREAS, the subject territory proposed to he a.nnexed to the City of Fresno will be exempted from taxation for the payment of principal or interest, or any other amounts which shall become due on account of any outstanding bonded indebt~• edness incurred by the City prior to the effective date of such annexation, and upon completion of this reorganization vroposal, the subject te~rri tory will be included in Municipal Bond Area "D 11 and will not be taxed for any existing bonded indebtedness or contractual obligations; and WHEREAS, the reasons :for this proposal are stated as ;f;ollows: 1. Annexation of the subject terri t6ry to the City of Fresno will result in improved land use planning. All private development controls of the City will apply, following reorganization. 2. The subject territory is within the City of Fresno's Sphere of Influence. 3. The project is in response to a LAFCO condition of approval applied to Church-Backer No. 4 District Reo~ga11ization, whereby recordation of said Church- Backer No. 4 would be held in abeyance pending rt~ceipt of an annexation proposal for the subject territory. 4.. :Ct is advantageous fo.r the subject territory tb be a part of the City. Page 2 of 3 • NOW, THEREFORE., BE IT RESOLVED that the Council of the City of Fresno hereby requests that proceedings be taken by. the Fresno Local Agency Formation Commission fojr the herein proposed Jensen-Chestnut No. 4 District Ret:,rgani~~ation, including the detachment of the subject territory, consisting of 93. 08 acres from the Mid Valley Fire Protecti()n District a,nd the Kings River Conservation District, detachment of a 92.10.,...acre portion of the subject territory from Fresno County Service Area No. 18, and annexation of the entir~! 93.08 acres to the City of Fresno; and BE IT FURTHER RESOLVED the Council of the C:i.ty of Fresno .f;inds adoption of this resolution making application for reorgan- izc1.tion constitutes an approval and a deter"minati.on to carry out a project within the meaning and intent of Public Resources Code Section 21152 and directs staff to file appropriate notice of determination consistent with the California Environmental Quality Act. OR . 8 ..2.w.,s '82 • SUMMARY SERVICE PLAN FOR THE JENSEN-CHESTNUT NO. 4 DISTRICT REORGANIZATION The purpose of this document is to provide a sum.m.ary of informatioln rega:.rding how municipal services will be provided to• the subject territory should annexation t9 the City occur; when such tnunicipal services would be available; any modifications to be made to existing facilities and how such facilities will be financed,. This service plan. has been prepared in aa-corclance.with the requirements of Govern ... ment Code Section. 35102. It provides an enumeration and description. of the servi--- ces to be extended to the affected ter:titory and the level and range of such " services.. It consists of responses from the £ollowir1g City Departments: Dev~'.lop- ment; :Public Works; Fresno Transit; Finance; Parks and Rec:reation; Police and Fi:r:e Protection, and from the Fresno Meti:opolitan Flood c,mtrol District. Copies <lf the original responses from the above-mentioned sources are available for .inspec..- tion with the City's Urban Unification Team .. The proposed Jensen-Chestnut No. 4 District Reorganization consists of 93.08 acres and is comprised of 433 parcels. The subject area is within the City of Fresno's Sphere of Influence boundary and. is generally located northwest of the intersection of E-Jensen and S. Chestnut Avenues. The subject territory, ia presently zoned R-1, Rt-2 and R-2-A, and the existing land. use consists of single family and multi- ple family residential development. Sewer e2ttention costs must be borne by the developer or prop.e:rty owner.. For those properties currently served, no change will occur in service. POLICE PROTECTIQN The proposed annexation presently receives police service froin1 the Fresno Sheriff 1 s Department, and traffic. enforcement ~.ervice fro:in the California Highway Patrol. Both responsibilities would be assumed by the llresno Police t1epa.rtment upon an11.ex- ation. The Police Department presently provides serviccas to almost t;be entire perimeter of this island. 111e response time to Priority O calls for service in the adjoin- ing area to the west of the island was s1ix minutes per call under the present de- ployment plan. This compares to a seven minute plus or minut:~ City-wide average. This :r.·esponse time is achieved with a deploymen1; of bet:ween three and five heats (depending on hour olt day) which are. within 1.5 miles of the proposed annexation. Current Fresno Police Department deployment patterns in the project area pennit a response to .Priority O calls equal to or b1atter than the exis~ting City-wide aver- age. We anticipate, however, this level of response wtll be impacted by the a.nti-.. cipated volume of Priority p calls to be generated by t;his project. We anticipate that additional police resources will he requi1red in the near future to meet anticipated work load increases. in this area. STREETS In accordance with the Major Streets and Highways Plan11 all projected major ,str,eets within or adjacent to the project area will be de.veloped to adopted City standards as follows (Exhibit "C-2" indicates streets w:lthin the'project area): 1. Arterial streets, 100-106 feet of right-of-way, 4-lane divided roadway; 2. Collector streets., 80-84 feet of right--of-way~ 4-lane undivided roadway. TRANSIT Fresno Transit c.u1:rently operates: Route No. 29 runs from Masten Towers in Downtown Fresno to Ward and Gould via Broadway Street ► Inyo Avenue, Fulton Street, Ventura Avenue, Kings Canyon Avenue, Chestnut Avenue, Wlnery Avenue, Hamilton Avenue, Cl1estnut Avenue, Sr. Citizens Village, back to Chestnut Avenue, Church Ave~ue" Maple Avenue, North Avenue, Chestnut Avenue, Muscat Avenue~ loops to Ward and Gould and returns by the same routE~. Route No. 38 runs from downtown Fresno to Bullard and Ceda1: via Fresno Street, Ma-,:tin Street, Walnut Avenue, Church Avenue, Fig Avenue, Jensen Avenue, Calwa Avenue, Cedar Avenue, Shaw Avenue, First Street, and back to Cedar Avenue. It returns by the same route. Service is adequate, and no service improvements are contemplated in the subject area at this time. Handyride currently serves this area. PARKS AND RECREATION Recreation services for the affected area are currently being met at the Cahra Park which is located northwest of the parcels to be annexed.. Inasmuch as the park is adjacent tp the area to be annexed!t i.t would be a duplication of services for the City to consider a new park development in the area. Additional recreation facil:i.ties in the vicinity of the-area to be annexed include: 1. ·Mosqueda Community Center -approximately 1 mile away. 2. East Fresno Boys Club; located approximately l½ miles away. 3. After school programs are currently provided for nine months a year at Aynesworth Elementary School, Calwa Elem~~ntary School and Lane Elementary School,. Roeding Park will provide for the regional park needs of the subject area. No maw facilit:tes would be necessary to meet the Park and Recreation needs of the area. FLOOD CONTROL The service delivery system of the'Fresno Met:ropolitan Flood Control District is generally divided into three basic types of service~3. First:, and foremost, is flood control pt:otection of lands within the District.. This responsibility entails; the protection of District lands from. the intrusion of flotJd waters from the foot- hill region. Secondly11 the District is responsible for thsi provisicm of urban storm d.rainag-e services as certain lands are converted to tiirban uses.. Finally, the District's service system entails the conservation of flood and storm waters for recharge to the groundwate1: reservoir.
