RESOLUTION NO. 82-559
A RESOLUTION OF THE COUNCIL OF THE CITY OF
FRESNO., C.~IFORNIA, IN SUPPORT OF A STATUTE
ELIMINATING DEED RESTRICTIONS ON PROPERTY
ADJACE.NT 1TO ~l1HE FRESNO AIR TERMINAL ..
WHEREAS, Chapter 1515 of the Statutes o:t: 1969, as amended
by Chapter 513 of the Statutes of 1978, auth;)rizE~d and directed
the Director of General Services of the State of California to
quitclaim state land adjacent to, the Fresno Air Terminal to the
City of Fresno on the condition that title to the land remain
in a public agency; and
WHERgAs, the State of California has retained the mineral
rights, together with the right to prospect for, mine, and
remove mineral deposits, in such land; and
WHEREAS, the above condi tj,ons and restrictions bave
prevented the City of Fresno from comprehensively utilizin9 the
land; and
WHEREAS, the ability of the City to convey title to all or
a portion of this land without the above restrictions will
enable tt1e City to provide for comprehensive and appropriate
development which will enhc1nce the long, ... term functional
integrity of the Fresno Air. Terminal; and
WHEREAS, the entire Fresno communi t~r and economy will
benefit from complete and appropriate a,~velopment. of the land;
and
WHEREAS., additional ta~r reve11µes will be generated for the
benefit of the State as well as the City as a result of such
de·velopment; and
WHEREAS, proper land use, planning, circulation, and air
traffic conside.r:ations will be adhered bJ in compliance with
the adopted Fresno Air Terminal Specific Plan(:•
NOW, THEREFORE, BE IT RESOLVE:D that the Council o:E the City
of Fresno does hereby request the State Legislature to approve

the legislation attached to this resolution as ~XH:£!LIT,. "A".
which will direct the Director of General Services to quitclaim
to the City of Fresno all interest.s 1:>f the State in certain
lands adjacent to the Fresno Air '.rerrninal without condition or
restriction of any kind.

THE PEOPL;E OF THE STATE OF CALIFORNIA DO ENACT J.1 .. S FOLLOWS:
SECTION 1. Section l of Chapter 1515 of the Statutes
of 1969, as amended by Section 1 of Chapter 513 of the Statutes·
of 1978, is amended to read:
SECTION l. The Director of General services
is hereby authorized and directed to
quitclaim to the City of Fresno, at no cost
to the city, all interests of the state in
that portion of land adjacent to the Fz:esno
Air Terminal in Section 20, Township 13
South, Range 21 East, Mount Diablo base and
meridian that was formerly owned by the
United States of America, given t<:> the State
of California for US€! by Fresno State
College, and has been declared surplus, being
some 352.5 acres, more or less, without
condition or 1:estr iction of any kind.
SECTION 2. Section 3 ,of Chapter 513 of the Statutes
of 1978 is hereby repealed.
