ORGANIZATION ORDERING A REOR<;AlifIZATION
OF THE CITY OF FRES'NOr THE NORTH CENTRAL
FIRE PROTECTION DIS'l'.'RICT AND THE KINGS
RIV':E:R CONSERVATION DISTRICT ..

WHEREAS, the Council of the City of Fresno, pursuant tc> its
Resolution of ~.pplication No. 82-99: adopted on March 2, 1982
requested the Fresno Local Agency Fiormation Com..mission to take
appropriate proceedings for the annu9x:ation of the subject ter-
ritory to the City of Fresno; and
WHEREAS, the proposed reorganization known as Shaw-Hayes
No .. 1 District Reorganization is de~;cribed in Exhibit 0 Au and graphi-
cally depicted in Exhibit uB"; and
WHEREAS, with notice given according to law, LAFCO met on
August 4, 1982 to hear interested persons and consider the p:ro-
posed reorganization: and adopted Resolution No. R0-82-28 °M~iking
Determina.tion and Approving Proposed Shaw-Hayes No .. 1 District
Reorganizationf' of the City of Fresno, the North Central Fire~
Protection District and the Kings River Conservation District; and
WHEREAS, LAl .. CO Resolution No. R0-82-28 authorized the Council
to conduct the p1~oceedings for the re~organization in the manner
provided by law; and
WHEREAS, on September 21, 1982 the Council initiated proceedings
for the proposed reorganization by adopting Resolution No. 82·-428,
"Resolution initiating proceedings for the reorganizat:lon of the
City of Fresno, the North Central Fir,1e :Protection Distt·ict and the
Kings River Conservation District", ai1d set a hearing on the proposed

reorganization for Oct.ober 26, 1982 at 3: 00 p .. m. in the~ Council
Chambers; and
WHEREAS, on October 26, 1982, the~ Council continue'.d the hear-
ing date to Decentber 7, 1982 at 3 :00 p.m .. , in the Council Chambersr
in order to allow time for LAFCO to consider a request for amend-
ment to its Resolution No. R0-82-28 approving the subject district
reorganization; and

WHEREAS, th€! Council gave the requi1:ed notice of the time and
place for hearing· objections to the proposed reorganization; and
WHEREAS, the Council conducted a hearing, at which time all
persons who wished to object to the proposed reorganization were
heard; and
WHEREAS,, written protests or objections to the proposed re-
organization, delivered to the Cl1a:rk of the Ci,ty of Fresno before
the hour set for hearing, were considered and are on file in the
office of the Clerk of the City o:f:: Fresno, County o:E F:i:esno, State
of California; and
WHEREAS, at said hearing and prior to consideration of protests,
LAFCO' s resolution making determination and approval was prt~sented
to the Council and summarized;' and
WHEREAS, the Council considert~d all factors required by law
for a reorganization; and
WHEREAS, the Council determinE~d that the territory to be :re-
organized is uninhabited and that written protests filed and not
withdrawn represented less than fifty percent {50%) of the assessed
value of land therein; and
WHEREAS, the Fresno County Assessor's roll will be used for
the purpose of levying any as!~essmen.ts or taxes on the subject
territory; and
WHEREAS, the territory proposed to be annexed to the City of
Fresno will be exempt from taxation for the payment of princ:Lpal
or interest, or any other amounts which shall become due on
account of any outstanding bonded in.debtedness incurred by the
City prior to the effective date of such annexation, and upon com-
pletion of this reorganization proposal, the subject territory will
be included in Municipal Bond Area npn and will not be taxed fo:r:-
any existing bonded indebtedness or contractual obligations; and
WHEREAS, pu.rsuant to Fresno Municipal Code Section 2-208, the
subject territory is allocated to council District No .. 2.
NOW, THERE:FOREr BE IT RESOLVED :by the Council of the City of
Fresno as follows:
1.. The Council hereby orders that the territory
referred to as Shaw-Hayes No. l District

and "Bur attached hereto, be annexed to the
City of Fresno, and the same territory be de-
tached from the Kings R:i\.ver conservation Dis-
trict and the North Central Fire Protection
District of Fresno County ..
2. This reorganization is in the best inte;:eest of thie
territory of Shaw-Hayes Mo. 1 District Reor-
ganization, and lands hav!•e not been improperly
orruni t.ted from or inr,:1 uded within this reorganiza,-
tion ..
3. The reasons for this reorganization are:
a. The subject territory is within the City of
Fresnots Sphere of Influence.,
b. Property owners within the project area
have petitioned for annexation to the City
c. It is advantages for the territory within
the Shaw~-Hayes No. 1 D.istriot Reorganiza-
tion to be a part of the City of Fresno.
4. The condition imposed by LAE\CO, namely that prior
to completion of the annexation, all landowners
or developers of parcels whic:h are undeveloped,
shalJ. enter into an agreement with the Central
Unified School District for the provision of school
facilities., will be substantially complied with prior to recordation
of the subject proposal ..
IT IS FURTHER RESOLVED by the Cou.ncil of the City of Fresno
that the Shaw-Hayes No.. 1 District Reor~;ranization be and is hereby
allocated to council District No. 2.
