A RESOLUTION OF THE COUNCIL O.F ~~HE CITY OF FRESNO,
ClU,IFORNIA, CONCURRING IN A RESOLUTION AND
FINDINGS OF CONDITIONS OF OVl~RCROWDING AS ADOPTED
BY THE CENTRAL UNIFIED SCHOOL DISTRICT, FRESNO
COUNTY, CALIFORNIA
WHEREAS, the Central Unified School District, Fresno County,
California, on October 12, 1982, adopted a Resolution and Findings
of Conditions of overcrowding and a Schedule of Fees for the purpose
of providing temporary school classrooms and facilities within the
District; and
WHEREAS, the District Resolution states that there are a number
of proposals to subdivide and develop land within the District for
residential uses, that such subdivision and development will
increase pupil enrollment so that the enrollment will exceed the
capacity of the existing schools, and that the District has
considered all reasonable means for mitigating the conditions of
overcrowding and has concluded that such measures are infeasible; and
WHEREAS, the District has served a c,oJ?Y of the RE~solution and
Findings and the Schedule of Fees upon the City Council; and
WHERE.AS, in accordance with Chapter 4. 7 of Di vision 1 of Title 7
of the California Government Code and Article 8 of Chapter 12 of the
Fresno Municipal Code, the Council is obligated to consider and take
appropriate action regarding such findings.
NOW, THEREFORE, BE IT RESOLVED that the Council hereby concurs
in the Central Unified School District's findings that conditions of
overcrowding will exist within the central Unified School District
attendance area upon d,evelopment of numerous residential projects
within the District.
BB IT FURTHER RESOLVED that the Councdl determines; that the
District Board has considered identifiable mitigation measures and
that such measures in the opinion of the School Board are not
feasible for reducing the stated conditi<:>ns of overcrc~wding,.
