WHElIBAS., the Council of the City of Fresno, pursuant to its Resolution of Application No .. 81-322 adopted on August 25, 1981, requested the Fresno Local Agency For- mation Commission to take appropriate proceedings for the annexation o:I: the subject territory to the City of Fresno; and WffBREAS ,, the proposed reorgani.zation known as Shields- Blythe No. 2-·A District Reorganization is described in Exhibit "A" and graphically depicted in Exhibit "Bn; and WHEREAS ,. with notice given according to law, LAFCO met on August 25, 1982 to hear interested persons and consider Ed Bie 1i cki the propose~d reorganization; and adopted Resolution No .. R0-82-22 "Making Determination and Approving Proposed Shields-Blythe No. 2-A. District Reorganization" of the City of Fresno, the North Central Fire Protection District and the Kings River Conservation District; and WHEREAS, LAFCO Resolution No. R0-82-22 authorized the Council to conduct the proceedings for the reorganization in the manner provided by law; and WHEREAS, on October 12, 1982 the Council initiated proceedings for the p:r:oposed reorganization by adopting Re- solution No. 82-481, ,uResolution initiating proceedings £or the reorganization of the City of Fresno, the North Central Fire Protaction District and the Kings River Conservation Dis- trict", and set a hearing on the proposed reorganization for November 16, 1982 at 3:00 p.m., in the Council Chambers; and WHEREAS, the Council gave the required notice of the time and place for hearing objections to the proposed reorganiza- tion; and Page 1 of 3 • WHEREAS, the Council conducted a hearing, at which time all persons who wished to object to the proposed reorgani2:ation were heard; and WHEH.EAS, written protests or objections to the pro- posed reo.rganization, delivered to the Clerk of the City of Fresno before the hour set for hearing, were considered and are on file: in the office of the Clerk of the City of Fresno, County of Fresno, State of California; and WHEREAS, at said hearing and prior to consideration of protests, Ll.1.FCO' s resolution making determination and approval was p1:esented to the Council and summarized; and WHEREAS, the Council considered all factors required by law for a rieorganization; and WHEREAS, the Council determined that the territory to be reorganized is uninhabited and that written protests filed and not withdrawn represented less than fifty per- cent (50%) of the assessed value of land therein; and WHEREAS, the Fresno County Assessor's l'.:oll will be used for the purpose of levying any assessments or taxes on the subject territoJCy; and WHEREAS, the territory proposed to be annexed to the City of Fresno will be exempt from taxation for the payment of p:ei.ncipal or interest, or any other amounts which shall become due on account of any outstanding bonded indebtedness incurred by the City prior to the effective date of: such annexation, and upon completion of this reorganization proposal, the subject bax·ritory will be included in Municipal Bond Area 11 Dn and will not be taxed for any existing bonded indebtedness or contractual obligatior1s; and WHEREAS, pursuant to Fresno Municipal Code Section 2-208, the subject territory is allocated to Council District No. 1. NOW, THERE:f?ORE, BE IT RE:SOLVED by the Council of the City of Fresno as follows: 1. The Council hereby orders that the territory referred to as Shields-Blythe No. 2-A District Page 2 of 3 ' . • Reorg·anization and described in Exhibits 0 An and uBi1 , attached hereto" be annexed to the City of Fresno,, and the same territory be detached from the Kings Rlver Conservation District and the North Central Fire Protection District of Fresno County .. 2. This reorganization is in the best int,erest of the territory of Shields-Blythe No .. 2-A District Re- organization, and la11ds have not been improperly ·omitted from or included within this reorganization .. 3. The reasons for this reorganization are: a. The subject territory is within the City of Fresno's Sphere of Influence. b. J?roperty owners within the project area have petitioned for annexation to the City of Fresno. c. It is advantageous for the territory within the Shields-Blythe No. 2-A District Reorganiza-• tion to be a part of the City of Fresno. IT IS FCRTHER RESOLVE~D by the Council of the City of Fresn(:> that the Shields-Blythe No,. 2-A District Reorganization be and is hereby allocated to Council District No. l.
