HomeMy WebLinkAboutResolution - City Council - 82-530 - 1982-11-16I • RESOLUTION NO. 82-530 RESOLUTION OF THE COUNCIL OF THE CITY OF PRESNO APPLYING TO THE FRESNO LOCAL AGENCY FO.RMATION C01"1MISSION IN THE MATTER OF THE l?ROPOSED BELMONT-WINERY NO,. 4 DISTRICT REORGANTZATION, INCLUDING THE DETACHMENT OF CERTAIN TERRITORY CONSISTING OF 4.37 ACRES FROM THE MID VALLEY FIRE PROTECT- ION DISTRICT AND ~~HE KINGS RIVER CONSERVA- TION DISTRICT; AND ANNEXATION OF SAID TER- RITORY TO THE CITY OE 1 FRESNO. Ed Bielicki WHEREAS, this proposal is made pursuant to the District Reorganization Act of 1965 contained in Division 1 of Title 6 (commencing with Section 56000) of the California Govern- ment Code; and WHEREAS, the nature of the proposed change is a reorgan- ization consisting of the detachment of certain territory consisting of 4 .. 37 acres and hereinafter called the 0 subject territory" from the Mid Valley Fire Protection District and the Kings River Conservation District, and annexation of the same te:cri tory to the City of Fresno; and WHEREAS, no other counties, cities, or districts are affected; and WHEREAS$ the proposed reorganization is uninhabited, is described in Exhibit "A.11 and graphically depicted in Exhibit "B"; and WHEREAS., the Master Service Delivery Plan., adopted by the Council on November 13, 1979, prepared in accordance with Government Code Section 35102, provides information for the City of Fresno's plans and policies for the pro- vision of services in the metropolitan area; and WHEREAS, pursuant to Resolution No. 80-172 1 the Council has approved the implementation of the Master Service Deli ver~r Plan; and WHEREAS, the Master Service Deli veiry Plan specifies City plans and policies for the provision of services to the sub- ject territory; and Page 1 of 3 • • WHEREAS, review and analysis of Environmental Assess- ment No., 3174, relating to the Master Service Delivery Plan has resulted in the filing of a Negative Declaration by the Director of the Development Departroenti and vIBEREAS, no new districts are proposed to be formed by this reorganization; and WHEREAS, the Ii'resr.io Coi.:mty Assessor• s roll will be used for the purpose of lev~·ing any assessments or taxes on the subject territory; and WHEREAS, the subject territory proposed to be annexed to the City of Fresno will be exempted from taxation for payment of principal or interest1 or any other amounts which shall become due on account of any outstanding bonded indebt- edness incurred by the City prior to the effective date of such annexation, and upon completion of this reorganization proposal, the subject territory will be included in Municipal Bond Area "D 0 and will not be ta:xed for any existing bonded indebtedness or contractual obligations; and WHEREAS, the reasons for this proposal are stated as follows: 1.. Annexation of the subject territory to the City of Fresno will result in improved land use planningo All private development con- trols of the City will apply, following re- organization. 28 The subject territory is within the City of Fresno's Sphere of Influence. 3 .. A property owner within the project area has requested annexation to the City. Eight of the remaining ten parcels are subject to a con- tract wherein property owners have agreed to con- sent to annexation to the City of Fresno in exchange for the City's agreement to extend municipcil water services to the properties. 4.. It is advantageous for the subject territory to be a part of the City. Page 2 of 3 • • NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Fresno hereby requests that proceedings be taken by the Fresno Local Agency Formation Commission for the herein proposed Belmont-Winery No. 4 District Rieorganization, including the detachment of the subject territory, consist- ing of 4.37 acres from the Mid Valley Fire Protection District and the Kings River Conservation District, and annexation of the same territory to the City of Fresno; and BE rr FURTHER RESOLVED that the Council of the City of Fresno finds Envix·onmental Assessment No. 3174 is the con- trolling environmental docun1ent for this annexation pro- posal, such environmental assessment has been ,~ompleted in compliance with the California Environmental Quality Act and the State Guidelines, and the Council has reviewed and considered the information contained in such environ- mental assessment pr!or to the approval of. the initiation of this annexation proposal and finds there is no poss- ibility such proposal may.have a significant effect on the environment.
