RESOLUTION OF THE COUNCIL OF THE CITY OF
PRESNO APPLYING TO THE FRESNO LOCAL AGENCY
FO.RMATION C01"1MISSION IN THE MATTER OF THE
l?ROPOSED BELMONT-WINERY NO,. 4 DISTRICT
REORGANTZATION, INCLUDING THE DETACHMENT
OF CERTAIN TERRITORY CONSISTING OF 4.37
ACRES FROM THE MID VALLEY FIRE PROTECT-
ION DISTRICT AND ~~HE KINGS RIVER CONSERVA-
TION DISTRICT; AND ANNEXATION OF SAID TER-
RITORY TO THE CITY OE 1 FRESNO.

WHEREAS, this proposal is made pursuant to the District
Reorganization Act of 1965 contained in Division 1 of Title
6 (commencing with Section 56000) of the California Govern-
ment Code; and
WHEREAS, the nature of the proposed change is a reorgan-
ization consisting of the detachment of certain territory
consisting of 4 .. 37 acres and hereinafter called the 0 subject
territory" from the Mid Valley Fire Protection District
and the Kings River Conservation District, and annexation of
the same te:cri tory to the City of Fresno; and
WHEREAS, no other counties, cities, or districts are
affected; and
WHEREAS$ the proposed reorganization is uninhabited,
is described in Exhibit "A.11 and graphically depicted in
Exhibit "B"; and
WHEREAS., the Master Service Delivery Plan., adopted by
the Council on November 13, 1979, prepared in accordance
with Government Code Section 35102, provides information
for the City of Fresno's plans and policies for the pro-
vision of services in the metropolitan area; and
WHEREAS, pursuant to Resolution No. 80-172 1 the Council
has approved the implementation of the Master Service Deli ver~r
Plan; and
WHEREAS, the Master Service Deli veiry Plan specifies City
plans and policies for the provision of services to the sub-
ject territory; and

• • WHEREAS, review and analysis of Environmental Assess-
ment No., 3174, relating to the Master Service Delivery
Plan has resulted in the filing of a Negative Declaration
by the Director of the Development Departroenti and
vIBEREAS, no new districts are proposed to be formed
by this reorganization; and
WHEREAS, the Ii'resr.io Coi.:mty Assessor• s roll will be
used for the purpose of lev~·ing any assessments or taxes on
the subject territory; and
WHEREAS, the subject territory proposed to be annexed
to the City of Fresno will be exempted from taxation for
payment of principal or interest1 or any other amounts which
shall become due on account of any outstanding bonded indebt-
edness incurred by the City prior to the effective date of
such annexation, and upon completion of this reorganization
proposal, the subject territory will be included in Municipal
Bond Area "D 0 and will not be ta:xed for any existing bonded
indebtedness or contractual obligations; and
WHEREAS, the reasons for this proposal are stated as
follows:
1.. Annexation of the subject territory to the
City of Fresno will result in improved land
use planningo All private development con-
trols of the City will apply, following re-
organization.
28 The subject territory is within the City of
Fresno's Sphere of Influence.
3 .. A property owner within the project area has
requested annexation to the City. Eight of
the remaining ten parcels are subject to a con-
tract wherein property owners have agreed to con-
sent to annexation to the City of Fresno in exchange
for the City's agreement to extend municipcil water
services to the properties.
4.. It is advantageous for the subject territory to
be a part of the City.

NOW, THEREFORE, BE IT RESOLVED that the Council of the
City of Fresno hereby requests that proceedings be taken by
the Fresno Local Agency Formation Commission for the herein
proposed Belmont-Winery No. 4 District Rieorganization,
including the detachment of the subject territory, consist-
ing of 4.37 acres from the Mid Valley Fire Protection
District and the Kings River Conservation District, and
annexation of the same territory to the City of Fresno; and
BE rr FURTHER RESOLVED that the Council of the City
of Fresno finds Envix·onmental Assessment No. 3174 is the con-
trolling environmental docun1ent for this annexation pro-
posal, such environmental assessment has been ,~ompleted
in compliance with the California Environmental Quality
Act and the State Guidelines, and the Council has reviewed
and considered the information contained in such environ-
mental assessment pr!or to the approval of. the initiation
of this annexation proposal and finds there is no poss-
ibility such proposal may.have a significant effect on
the environment.

Area to be Detached from the Mid Valley Fire Protection District, the Kings River
Conservation District., and Annexation to the City of Fresno.
Consisting of Lots 6, 7, 8 and portions of Lots 9 and 10 of Block 2, of Belmont
Gardens, lying in Section 31, 13/21, M .. D.B.&M ..
BEGINNING at the Northeast corner of the No·tthwest Quarter of the Northwest
Quarter of Section 6, Township 14 South, Ra'.nge 21 East, Mount Diablo Base and
Meridian, as said Section is shown on the United States Government Township
Plats, being also, a point on the existing City Limits of the City of F1:esno;
thence Westerly, along the North line of the Northwest Quarter of the Northwest
Quarter of said Section 6, being also the South line of the Southwest Quarter
of Section 31, Township 13 South, Range ·21 East, Mount Diablo Base and Meridian,
as said Sec.tion is shown on the United States Government Township Plats, being
also, along the existing City Limits of said City, to the intersection with a
line which is parallel with and 30.00 feet East of the East Line of Lot 6, in
Block 1 of Belmont Gardens:, as said lot is shown on the Map thereof, filed in

at page 39,, Fresno County Records; thence Northerly,, along a line which is par-
allel with and 30.00 feet East of the East line of said Lot 6,f in Block 1, b:=:ing
also along the existing City Limits of said City, to the intersection with a line
which is parallel with and 140. 00 feet South of the North li1).e of L()t 10, in Block
