HomeMy WebLinkAboutResolution - City Council - 82-525 - 1982-11-09. .. ;iii • RESOLUTION NO. 82-525 A RESOLUTION OF THE COUNCIL OF THE CIT)r OF FRESNO, CALIFORNIA, CERTIFYING FINAL EHVIRONMEMTAt IMPACT REPORT NO. 10083 AND CONTAINING FINDINGS REGARDING SIGNIFICANT ADVERSE EFFECTS IDENTIFIED IN FINAL ENVIRONMENTAL IMPACT REPORT NO .• 10083 :RELATING TO REZONING APPLICATION NO. 6529-B FILED J;iY THE PEOPLES FOUNDATION, REQUESTING A ZONE CHANGE .FROM R-A AND AE-5/UGM TO C-P/EA, C-P/EA/UGM AND C-1/EA/UGM FOR 25 ACRES LOCATED ON THE NOR 1rH SIDE OF EAST HERNDON AVENUE BETWEEN NORTH CEDAR ,\ND NORTH MAPLE AVENUES Development WHEREAS, Final Environmental Impact Report No. 10083 relating to Rezoning Application No. 6529-B has been prepared in complianc~e with the California Environmental Quality Act; and WHEREAS, Final Environmental Impact Report No. 10083 has been presented to the Council of the City of Fresno for review and consideration .. NOW, THEREFORE, BE IT RESOLVED that the c~uncil of the City of Fresno certifies that Final Environmental Impact Report No. 10083 has bee1n completed in compliance with the California Environmental Quality Ordinance Act, the State EIR Guidelines, and the Cityls Environmental Quality Ordinance, and that the Council has reviewed and considered the information contained therein. BE I 1r FURTHER RESOLVED the Council finds that the adoption of the following mitigation measures will mitigate or avoid the significant environmental effects as identified in the Final Environmental Impact Report:. A. OFFICE AND COMMERCIAL FLOOR AREJ~ LIMITATIONS -- l. There shall be no greater than 160,400 square feet of office floor area constructed on the portion of the subject property zoned C-P/EA and C-P/EA/UGM. 2. There shall be no greater than 40 1 000 sguare feet of cornmercial floor area constructed on the portion c,f the subject property zoned C-1/EA/UGM. B .. TRAFFIC The property owner shall provide the following improvements ana dedications: E. Herndon Avenue 1. Rest ripe E. Herndon .Avenue to six lanes between Na Blackstone and N. Cedar Avenues. 2. Dedicate and improve the north side of E. Herndon .Avenue between N. Cedar and No Maple Avenues to the width necessary to accommodate three westbound travel lanes. • • 3. Acquire necessary right-of-way and construct dual eastbound and westbound left-turn lanes on Herndon at th,e Cedar Avenue intersection .. 4.. Dual left-turn laneis must be constructed at Maple Avenue to accommodate eastbound to northbound left-turn movements from Herndon to Maple. N~ Maple Avenue (one of the below) Sa Acquire necessary right-of-way for and construct the north leg of Maple Avenue to its ultimate location (~everse curve connecting the south and north leg of Maple Avenue); or 6. Provide a local street (public or private) to connect the site to the intersection of Herndon Avenue with the south leg of Maple Avenue. N. Ceda.r Avenue 7. Construct the center two lanes include the raised median islands between Herndon and Spruce. 8. Dedicate additional right-of-way and install str1eet improvements on the east side of Cedar Avenue across the project frontage no1~th of Herndon A1venue to a width that will allow eventual installation of dual southbound left turns at Herndon, two through northbound lanes and a bus turn-out area. C. SEWER An on-site sewage discharge reducing fac:tlity must be installed with this project. The facility must be designed so that the maximum average sewage discharge does not exceed 28,500 gallons per day, which is the amount of sewage discharge anticipated for the subject property based on the land use designation of the adopted Community Plan. D. STORMWATER DRAINAGE The proposed project shall be required to build a 48-inch storm drainage pipeline in N. Cedar Avenue from the north side of E. Herndon Avenue at its inter.section with N. CE~dar Avenue to drainage basin "'CM," 1/4 mile south of Herndon Avenue. If the pipeline is already built at the time of development, the proposed project shall pay its fair share of the cost as determined by Fresno Metropolitan Flood Control District. BE IT FURTHER RESOLVED that the Council finds that the growth- inducing impact of the project and the impact of the project up{)l'll air quality cannot be feasibly mitigated. -2- "I • • CLERK'S CERTIFICATE STATE OF CALIFORNIA ) COUNTY OF FRESNO ) ss.
