A RESOLUTION OF THE COUNCIL OF THE ClTY OF FRESNO,
CALIFORNIA, ORDERING THE VACATION OEr A SEWER EASEMENT
WHEREAS, the Council has elected to proceed under the pro~
visi.ons of the Public Streets, Highways and Service Easements
Vacation Law (Division 9, Part 3 of the Streets a11d Highwayls
Code of the State of California), and specifically, Chapter 4,
commencing with Section 8330 ther,eof, to vacate ar.ty portion of
an easement which has not been used for the purpose for which
it was d!edi(!ated or acquired for five consecutive years immedi-
ately preceding this proposed vacation; and
WHEREAS, the sewer easement proposed to be vacated is de-
scribed as follows:
The entire Northeast Quarter of Section 13, Town-
ship 14 South, Range 19 East. (This Quarter being
oounded by California, Chur(:?h, Valentine and Marks.)
Excepting therefrom the East 50 fe1et and the South 50
feet of said Quarter Seetion.
For further particulars as to the proposed vacation> refer•
ence is hereby made to the attached Exhibit 0 Au; and
WHEREAS jl said sewer easement was granted to the City of
:b"'resno for s,ewer purposes; and
WHEREAS, the sewer easement proposed to be va.cat,ed has not '

been used for the purpose for which it was gt·anted for more
than five consecutive years, and no public money has been ex-
pended to maintain this easement during the five-year period;
and
WHEREAS, findingn of Environmental Assessment No. 4567
indicate that the proposed vacation act.ion will have no possi-
bility of significan1: adverse €iJfects on the environment:; and
WI'lfi:REAS, the Council desires to vacate such sewer easement.
NOW,. THEREFORE, IT IS RESOLVED by the Council of the City
of Fresno as follows:
1.. That the sewer easement, granted to the City of
Fresno, :ts in, upon., over and across the hereinabove-described
real property, be and the same is hereby vacated for sewer
