RESOLUTION NO. 82-502
A RESOLUTION OF THE COUNCIL OF THE CITY' OF FRESNO,
CALIFORNIA" EXTENDING A MORATORIUM ON THE PROCESSING,
.REVIEW, APPROVAL OF DEVELOPMENT ENTITLEMENTS FOR
CERTAIN PROPERTIES LOCATED WITHIN THE SOUTHWEST FRESNO
GENERAL NEIGHBORHOOD RENEWAL AREA PROJECT
WHEREAS, on February 16, 1982, the Council of the City
of Fresno initiated the public review and hearing proces~~
for proposed amendments to the Southwest Fresno General
Neighborhood Re:ne-wal Area {GNRA) Project U:rbar.1 Renetval Plan,
and set April 13, 1982, as the date for the joint public
hearing on the proposed amendments before the Redevelopment
Agency and Council of the City of Fresno; and
WHEREAS, the said public hearing date was continued to
April 27, 1982; June 8, 1982; June 22, 1982; July 13, 1982i
August 3, 1982; September 14, 1982; October 12., 1982;
October 26 1 1982; and has subsequently been continued to
January 25, 1983; and
WHEREAS, the council has determined that a moratorium
on construction or development for certain properties within
the Southwest Fres110 GNRA Project (hereafter refe:r.red to as
"The :Project Area") is necessary to ensure that the purposes
of the Community Redevelopment Law are not impaired during
the period in which the proposed amendments are in the
process of public review and hearing, and that properties
within the Project Area are not economically or irreversibly
committed to uses which would be inconsistent with the
amendments as ultimately adopted by the Council and the
Agency; and
vffiEREA.S,. concurrently with the initiation of the said
public review and hearing process, the Council has a.dopted
Resolution No. 82-66, thereby establishing a moratorium

wherein no applications for any development entitlements £01~
certain properties within the Project Area, including but
not limited to subdivisions, rezonings, special permits,
building permits for new uses or expanded uses or structures,
which are not in conformance with the proposed amendments,
shall be accepted" processed, or approved by the City of
Fresno; and
WHEREAS, on April 27, 1982, the Council adopted Resolu-
tion No 82-192, thereby extiending the said moratorium for a
period of sixty (60) days; and
WHEREAS, on June 22 1 1982, the Council adopted Resolu-
tion No. 82-283, further extending the said inoratorium for a
period of forty-five {45) days; and
WHEREAS,. pursuant to the provisions of Resc)lution
No. 82-28 3, the said moratorium expired and vtas of no further
force and effect at 12: 01 a .. m. , on the 46th day fol.lowing
the adoption of the said resolution; and
WHEREAS, on September 28, 1982, the Council adopted
Resolution No. 82-451, thereby reinstating the said mora-
torium .for a period of sixty (60) days; and
WHEREAS, pursuant to the provisions of Resolution No.
82-451, the said moratorium will expire and be of no further
force and effect at 12 .01 a.m., on November 28, 1982; and
WHEREAS, the continuance of the public hearing date to
January 25, 1983$ necessitaties a further extension of the
said moratorium in order to maintain its purposes and intent.

NOW, THEREFORE, BE IT RESOLVED, by the Council of the
City of Fresno as follows:
.1.. The moratorium established by Resolution No. 82-66,
relating to the processing review, approval of develop-
men.t entitlements for ce.rtain properties located within
the Southwest Fresno General Neighborhood Renewal Area
Project, as shown on the attached Exhibit nAu, extended
by Resolutions No .. 82-192 and 82-283, and reinstated by
Resolution No. 82-451, is hereby further extended, and
shall remain in full force and effe.ct until 12; 01 a.m .. ,
on the 103rd day following the adoption of this resolu-
tion, unless sooner rescinded.
