A RESOLUTION OF THE COUNCIL OF 11:HE CITY OF
FRESNO, CALIFORNIA, OVERRULING THE FINDINGS
OF THE FRESNO COUNTY AIRPORT ·LAN,D USE
COMMISSION CONCERNING THE FRESNO· ... CHANDLER
DOWNTOWN AIRPORT ENVIRONS SPECIF:CC PLAN.

WHEREAS, on May 25, 1982, the Council adopted the
Fresno-Chandler Airport Environs Specific Plan which deleted
C•ertain proposed density restrictions, avigation easement
requirements, <;tnd the provision for a max:inrum noise level for
aircraft; and
WHEREAS, on May 25, 1982, the Council also rejected a
recommendation o,f the Fresno county Airport Land USE~ Commission
(ALUC) to acquire properties within the cleat· zone through
negotiated sales in the open market when such properties become .
available; and
WHEREAS,. the A.LUC on August 9 , 1982, fout1d that such
action would be harmful to and not in the best interest of the
Fresno-Chandler Downtown Airp.ort and adjacent areas; and
WHEREAS, the State Aeronautics Act (Division 9, Part 1,
Chapter 4, Article 3.5, Section 21676 of the Calif.ornia Public
Utilities Code) provides the finding of the Atoe shall not be
binding upon the a:efected public aget1cy tf after hearing such
finding is overruled by a four-fifths vote o,f its governing
body.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City'
of Fresno that the finding of the Fresno County .~irport Land
Use Commission is her,eby overruled and that the l?resno-Chandler
Downtown Airport Environs Specific Plan is reaffirmed as
adopted on May 25, 1982.
