REORGANIZATION ORDERING A REORGANizA .. -
TION OF THE CITY OF FRESNO, THE MID
V,ALLEY FIRE PROir 1ECTION DISTRICT AND
THE KINGS RIVER CONSERVATION DISTRICT.

WHEREAS, the Council of the City of Fresno, pursuant
to its Resolution of Application No. 82-1 adopted on
January 5, 1982, requested the Fresno Local Agency For-
mation Commission to take appropriate proceedings fot: the
annexati..on of the subject territory to the City of Fresno;
and
WHEREAS, the proposed reorganization known as California-
Clovis No. 2 District Reorganization is described in
Exhibit 0 1\," and graphically depicted in Exhibit 0 B 0
; and
WHEREAS, with notice given acco)::-ding to law, LAFCO met
on June 23, 1982 to hear interested persons and consider
the proposed reorganization; and adopted Resolution No,. R0-82-27
"Making Determination and Approving f'roposed California-Clovis
No. 2, District Reorganization" of the City of Fresno, the
Mid Valley Fire Protection District and the Kings Rive~
Conservation District; and
WHEREAS, a request was presented to the Commission ori
August 4, 1982, to revise said Resolu·l::ion No. R0-82-27 to delete
Condition No. 3 requiring 11 annexation also to the Fresno Metro-
politan Flood Control District as a pa,rt of this reorganization",
and
WHEREAS, on August 4, 1982, the Fresno Local Agency Formation
Commission revised its Resolution No. RO-82-27, by adopting its
Resolution No-R0-82-27a, approval of the request to delete said
condition No~ 2 requiring annexation to Fresno Metropolitan Flood
Control District; and
WHEREAS, LAFCO Resolution No .. RO-82-27 authorized the
Council to conduct the proceedings for the reorganization in
the manner provided by law; and

WHEREAS, on September 28, 1982 the Council initiated
proceedings for the proposed reorganization by adopting Re-
solution No. 8:2-442, "Resolution initiating proceedings for
the reorganization uf the City o:e Fresno., thE~ Mid Valley
Fire Protection District and the Kings River Conservation Dis-
trict 11 , and set a hearing on the proposed reci:rganization for
October 26, 1982 at 3:00 p.m .. , in the Council Chambers; and
WHEREAS, the Council gave the required notice of the ti1ne
and place £or hearing objections to the propoE~ed reorganiza,-
tion; and
WHEREAS, the Council conducted a hearing, at which time
all persons who wished to object to the proposed reorganization
were heard; and
WHEREAS, written protests or objections to the pro-
posed reorganization, delivered to the Clerk of the City
of Fresno before the hour set :for hearing, were considered
and a.re on file in the off ice of the Clerk of the City of
Fresno, County of Fresno, State of California; and
WHEREAS, at said hearing and prior to consideration
of protests, LAFCO's resolution making determination and
approval was presented to the Council and summarized; and
WHEREAS, the Council considered all factors required
by law for a reorganizattion; and
WHEREAS, the Council determined that the territory
to be reorganized is uninhabited and that writt,en protests
filed and not withdrawn represented less than fifty per-
cent (50%) of the assessed value of land therein; and
WHEREAS, the Fresno Cou11ty Assessor's roll will be
used for the purpose of levying any assessments or taxes
on the subject territory; and
WHEREAS, the territory proposed to be annexed to the
City of Fresno will be exempt from taxation for the payment
of principal or interest, or any other ainount~;) which shall

become due on account of an~l outstanding bonded indebtedness
incurred by the City prior to the effective date of such
annexation, and upon completion of this reorganization proposal,

the subject territory will be included in Municipal Bond
Area "D" and will not be taxed for any existing bond indebt-
edness or contractual obligations; and
WHEREAS, pursuant to Fresno Municipal Code Section 2-
2 O 8, the subject barri tory is allocated to Coun.cil District
No. 5 ..
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Fresno as follows:
1. The Council hereby orders that the territory
referred to as Californi,a-Clovis No.. 2 District
Reorganization and described in Exhibits "Au and 0 B",
attached hereto, be annexed to the City of Fresno,
and the same te;cr i tory be detached from the Kings
River Conservation District and the Mid Valley
Fire Protection District of Fr1esno County ..
2.. This reorganization is in the best. interest of the
territory of California-Clovis No. 2 District Re-
organization, and lands have not been improperly
omitted from or included within this reorgani.zation ..
3. The reasons for this reorganization are:
a. The subject territory is within the City of
Fresno's Sphere of Influence ..
b. Property owners within the project area
petitioned for annexation to the City of
Fresno.
c. It is advantageous for the territory within
the California•-Clovis No. 2 District Reorganiza-
tion to be a part of the City of Fresno.
4. The transaction to purchase the fire station is
expected to be completed in the near future and the
City has indicated its willingness to agree to water-·
main intertie with CWWD No. 24, all in compliance
with LAFco•s condition of approval,.
IT IS FURTHER RESOLVED by the Council of the City of Fresno
that the California-Clovis No. 2 District Reorganization be and
1s hereby allocated to Council District No. 5 ..

9 WHEREAS, an application for said proposal was accepted for
10 filing by the Executive Officer of this Local Agency Formation
J .. l. Commission; and
12 WHEREAS, said application was set for hearing by the Executi Vtl'
13 Officer on the 25th day of August, 1982, at the hour of 2:45 p .. m ..
14 of said day; and
15 WHEREAS, notice of the hearing of said applictation was duly

16 given by mail, posting, and newspaper publication as required by
17 law; and
18 WHEREAS, the Executive Officer reviewed s.aid application and
19 prepared a report, ·including hi;:r recommendations thereon, said
20 application and.report having been presented to and considered by
21 this Commission; and
22 WHEREAS, this Commission considered all r(~levant factors anc1
23 heard all interested parties wishing to speak on said application;

25 .WHEREAS, the Commission has reviewed and considered the
26 information in the Negative Declaration as provided in the Executive

4 conducting agency ordering this 'reorganization shall provide that
5 such reorganization shall be subject to the following terms and
6 conditions:
7 1. The City shall purchase the site for a new fire station,
8 located near the vicinity of Clovis and Butler Avenues.
9 2. 'rhere shall be an agreement by the City for a water main
10 intertie with Waterworks District No. 2•4; the irltertie to be near
11 California and Fowler Avenues.
12 3. Included in the proposal shall be an annexation to the
13 Fresno Metropolitan Flood Control District for that area. not in
14 the District north of Jensen Avenue, near Sunnyside Avenue.
15 Section 2. Said territory is founct·to be uninhabited and
' 16 is assigned the following distinctive short form designation:

18 Section 3. The City of Fresno is designated as the conducting·
19 agency, and the governing body of said agency is hereby directed
20 to initiate reorganization proceedings i11 compliance with this
21 resolution.
22 section 4. Further proceedings shall be initiated by the
23 conducting agiency not later than 35 days after the date 0£ adoption

24 of the Commis:sion resolution, and shall be conducted and completed
25 pursuant to required law. Proceedings and.any resolution of
26 approval shall comply with the Commission's resolution of approval.
