RESOLUTION NO. 82-490
RESOLUTION OF THE COUNCIL OF THE CITY OF
FRESNO APPLYING TO THE FRESNO LOCAL AGJ~NCY
FORMATION COMMISSION IN THE MATTER OF THE
PROPOSED. TOWER ... ·BACKER NO. 4 DISTRICT
REORGANIZATION, INCLUDING THE DETACHMENT
OF CERTAIN TERRITORY CONSISTING OF 8 .. 90
ACRES FROM THE MID V1\LLEY FIRE PROTECT-
ION DISTRICT AND THE KINGS RIVER CONSERVA-
TION DISTRICT, AND ANNEXATION OF SAID TER-
RITORY TO THE CIT'Y OF FRESNO.
WHEREAS, this proposal is made pursuant to the District
Reorganization Act of 1965 contained in Division 1 of Title
6 (commencing with Se~ction 56000) of the California Govern-
ment Code; and

WHEREAS, the nature of the proposed change is a reorgan-
ization consisting of the detachment of certain territory
consisting of B.90 acres and hereinafter called the nsubject
territoryn from the Mid Valley Fire Protection District
and the Kings River Conservation District, and annexation of
the same te:r:ri tory to the City of Fresno 1: and
WHEREAS, no other counties, cities, or districts are
affected; and
WHEREAS, the proposed reorganization is uninhabited,
is described in Exhibit 11 A" and graphically depicted in
Exhibit "B"; and
WHEREAS, the Master SeJCvice Delivery Plan, adopted by
the Council on November 13, 1979, prepared in accordance
with Government Code Section 35102, provides information
for the City of Fresno's plans and policies for the pro-
vision of services in the metropolitan area; and
WHEREAS, pursuant to Resolution No. 80-172, the Council
has approved the implementation of the Master Service Delivery
Plan; and
WHEREAS, the Master Service Delivery Plan specifies City
plans and policies for the provision of services to the 0 ub-

WHERE.A.S, review and analysis of Environmenta.l Asse~3s-
ment No. 31741 relating to the Master ServicE~ Delivery
Plan has resulted in the filing of a Negative Declaration
by the Director of the Dev:elopment Department; and
WHEREAS, no new districts are proposed to be formed
by this reorganization; and
WHEREAS, the Fresno County Assessor's roll will be
used for the purpose of levying any assessments or taxes on
the subject territory; and
WHEREAS, the subject territory proposed to be annexed
to the City of Fresno will be exempted from taxation for
payment of principal or int(3rest, or any other amounts which
shall become due on account of any outstanding bonded indebt,..,
edness incurred by the City prior to the effective date of
such annexation, and upon completion of thi~; reorganization
proposal, the subject terri t:o:ry will. be included in Municipal
Bond Area 11 D0 and will not be taxed for a:ny existing bonded
indebtedness or contractual obligations; and
WHEREAS, the reasons for this proposal are stated as
follows:
1. Annexation of the subject territory to the
City of Fresno will result in improved land
use planning. All private development con-
tr()ls of the City will apply, following re-
organization.
2. The subject territory is within the City of
Fresno's Sphere of Influence ..
3. This annexation is beincr initiated as a result
of a condition imposed by LAFCO, that an unincorporated
corridor County island be annexed to the City of
Fresno.
4. It is advantageous for the subject territory to
be a part of the City~

NOW, THEREFORE, BE IT RESOLVED that the Co1.1ncil of the
City of Fresno hereby requests that proceedings be taken by
the Fresnc> Local Agency Formation Commission for the herei11
proposed 'I'ower-Backer No. 4 District Reorganization,
including the detachment of the subject territory, consist-
ing of 8 . 9 O acres from the Mid Valley E1ire Protection
District and the Kings River Conservation District, and
annexation of the same territory to the City of Fresno; and
BE IT FURTHER RESOLVED that the Council of the City
of Fresno finds Environmental Assessment No,. 3174 is the con-
trolling environmental document for this annexation pro-
posal, such environmental assessment has been completed
in compliance with the California Environmental Quality
Act and the State Guidelines, and the Council has reviewed
and considered the information contained in such e11viron--
men tal assessment prior to the approval oft.he initiation
of this annexation proposal and finds there is no poss•-
ibility such proposal may have a significant effect on
the environment.
