RESOLUTION OF THE COUNCIL OF THE CITY OF
FRESNO AP?LYING TO THE FRESNO LOCAL AGENCY
FORMATION COMMISSION IN THE MATTER OF TliE
PROPOSED WHITE-CHESTNUT NO. 4 DISTRICT
REORGANIZATION, INCLUDING ~HE DETACHMENT
OF CERTAIN TERRITORY CONSISTING OF 67.92
ACRES FnOM THE MID VALLEY FIRE PROTECT-
ION DISTRICT AND THE KINGS RIVER CONSERVA-
TION DISTRICT, AND ANNEXATION OF SAID TER-
RITORY TO THE CITY OF FRESNO.

WHEREAS, this proposal is made pursuant to the District
Reorganization Act of 1965 contained in Division 1 of Title
6 (commencing with Section 56000) of the California Govern-
ment Code; and
WHEREAS, the nature of the proposed change is a reorgan-
ization consisting of the detachment of certain territory
consisting of 67-92 acres and hereinafter called the 11 subject
territory" from the Mid Valley Fire Protection District
and the Kings River Conservation District, and annexation of
the same territory to the City of Fresno; and
WHEREA.S, no other counties, cities, or districts are
affected; and
WHEREAS, the proposed reorganization is inhabited,
is described in Exhibit 0 A" and graphically depicted in
Exhibit 0 Bn; and
WHEREAS, the Master Service Deli very Platl I adopted by
the Council on November 13, 1979, prepared in accordance
with Governrnent Code S1ection 35102, provides information
for the City of Fresno's plans and policies for the pro-
vision of services in the metropolitan area; and
WHEREAS, pursuant to Resolution No. 80-172, the Council
has approved the implementation of the Master Service Dt~li very
Pla.n; and
WHEREAS, the Master Service Delivery Plan specifies City
plans and policies for the provision of services to the sub-
ject territory·; and

• tfflEREAS, review and analysis of Enviromn.ental Assess-
ment No. 3174, relating to the Master Service Delivery
Plan has resulted in the filing of a Negative Declaration
by the Director of the Development Detpartment; a.nd
WHEREAS, no new districts are propos~~d to be formed
by this reorganization; and
WHEREASr the Fresno County Assessor's roll will be
used for the purpose of levying any assessments or taxes on
the subject territory; and
WHEREAS, the subject territory proposed to be annexed
to the City of Fresno will be exempted from taxation for
payment of principal or interest, or any other amounts which
shall becc>me due on account of any outstanding bonded indebt-
edness incurred by the City prior to the effective date of
such annexation, and upon completion of this reorganization
proposal, the subject territory will be included in Municipal
Bond Area "D 11 and will not be taxed for any existing bonded
indebtedness or contractual obligations; and
WHEREAS, the reasons for this proposal are stated as
follows:
1. AnneJtation of the subject tex·ritory to the
City of Fresno will result in improved land
use planning. All private development con-
trols of the City will apply, following re-
organization.
2. The subject territory is within the City of
ltresno' s Sphere of Influence.
3. Th.is project comes in response to a condition
imposed by LAFCO, whereby the City of Fresno was
required to submit an annexation proposal for the
unincorporated i:3land created to-the west of White-,.
GaJ:den No. 4 District Reorganization.
4.. It is advantageous for the subject territory to
be a part of the City.

NOW, THEREFORE, BE IT RESOLVED that the Council ()If the
City of Fresno hereby requests that proceedings be tafen by
the Fresno Local Agency Formation Commission for the herein
proposed White-Chestnut No. 4 District Reorganization,
including the detachment of the subj.ect territory,~ consist-
\
ing of 67.92 acres from the Mid Valley Fire Protection
District and the Kings River Conservation District, a.nd
annexation of the same territory to the City cf Fresno; a,nd
BE IT FURTHER RESOLVED that the Council of the City
of Fresno finds Environmental Assessment No .. 3174 is the con-
trolling environmental document for this annexation J?ro-
posal, such environmental assessment has been completed
in compliance with the California Environmental Quality
Act and the State Guidelines, and the Council has re·viewed
and considered the information contained in such environ-
mental assessment prior to the approval. of the initiation
of this annexation proposal and finds there is no poss-
ibility sucl1; proposal may have a significant effect on
the environment.
