HomeMy WebLinkAboutResolution - City Council - 82-488 - 1982-10-26• RESOLUTION NO. 82--£}88 A RESOLUTION OF THE COUNClL OF THg CITY OF FRESNO, CALIFORNIA, DETERMINING PUBLIC CONVENIENCE,AND NECESSITY OF PROPOSED IMPROVEMENTS OR ACQUISITIONS REGARDING CITY OF FRESNO ASSESSMENT DISTRICT NO. 88 WEREAS, by its Resolution No. 82-472, this Cout1c:i-l did pr1eliminarily determine that the public convenience and neces~· sity require the improvements and/or acquisitions and proceed- :tngs without complying with the provisions of the Special .As.sessment Investigation, Li:mitation and Majority P"lcotest Act of 1931; and WHEREAS, such Re.solution did further fix Tuesday,, the 26th day of October, 1982, at the hour of 2:00 p.m., in the x·egular meeting place of this Counci.l, Council Chambers, City Hall, 2326 Fresno Street, Fresno, California, as the time anq place where any and all persons i11terested may appear and ~~how cause~ if any they have, why this Council should not finally find and determine that the public c~::>nvenience and 11ecessity require the proposed improvements and a,cquisition~; without compliance with the '*Special Assessment Investigation, Limitation and Majority Protest Act of 193lu and object to the undertaking of such pro- ceedings without first complying with the provisions of the Investigation Act; and WHEREAS, it appears that such Resolution was duly published as e•videnced by the affidavits on file with the City Clerk;; and WHEREAS, such hearing was duly opened and held; and WHEREAS., at such hearing all persons intersted and desiiri.ng to be hE~ard were given opportunity to be heard; and all matters and things pertaining to the public conveniertce and necessity of the impro,,ements and the -undertaking thereof by special assessment and assessment bond proceedi.ngs we,re fully heard and. considered by Council. NOW, THEREF'OREt THE COUNCIL OF THE CITY OF FRESNO DOES HEREBY RESOLVE, FIND, DETERMINE AND ORDER. AS FOLLOWS: 1. The following is a general description of the proposed improvements to be constructed and acquired within the proposed;_, .. • • -2- assessment district, the boundaries of wh:tch are m.ore particu- la.rly shown on the map on file with the Clerk of the City of Fresno, designated Boundaries of City of Fresno Assessment District No. 88: Constl.'uction and installation of approximately 4,812 lineal feet of 48-inch reinforced concrete pipe along the westerly side of Fresno Street between Bullard Avenue and Herndon Avenue, vent pipes, stand pipes, trenching, resurfacing where required; the doing of all transition work and the construction and acquisi- tion of all improvements and rights-of-way auxiliary to any of the foregoing and necessary to carry out same in accordance with the requirements of the City of FrE~sno. 2. The public convenience and necessity require that the proposed improvements be done and made and that the Special Assessment Investigation, Limitation and Majority Protest Act of 1931 shall not apply. 3.
