ilESOLUTION ORDERING THE VACATION OF THE uGu-SARAH
J:LLEY BETWEEN FLORENCE AVENUE AND "Gn STREET
WHERE.AS, pursuant to Resolution of Intention No. 825-D, 011
file in the Office of the City Clerk, a public hearing was held
on the 12th day of October, 1982, at a regular meeting of
Council of the City of Fresx:10, County of Fresno, State -of
California, at which time and place evidence was heard for and
against the va.cation of the hereinafter described rights of way
or parts thereiof, si.tuated within the City of Fresno; and
WHEREAS, the City Traffic Erigineer has reviewed the pro-
posed vacation action and determined that it will have no ad-
verse effect upon traffic circulation; and
WHEREAS, the Council finds and determines that the rights
of way or parts thereof proposed to be vacated are not useful
as bicycle paths or routes; and
WHEREAS, findings of Environmental Assessment No. 4532 in-
dicate that the proposed vacation action will ha.ve uno possi-
bility of significant adverse effect on the environment!I; and
WHERE:AS, the Council of 1:he City of Fresno finds from all
evidence submitted that such rights of way of par'ts there.of are·
unnecessary for present and prospective public: street purposes;
and
WHEREAS, this acti.on is --being taken pursuant to the provi-
sions of the Public Streets, Highways, and Service Easements
Vacation Law, being Sections 8300-8363, Part 3, Divi.sion 9 of
the Streets and Highways Code of the State of California.
NOW, THEREFORE, BE IT RESOLVED:
1.. The public interest and conven:tence require, and it is
hereby ordered, that as contemplated by Resolution of Intention
No. 825-D, adopted by the Council of the City of Fresno on the
21st day of September, 1982, the hereinaft:(~r described, rights
of way or parts thereof situated in the City of Fresno be and
the same are hereby closed, vacated and abandoned for public
street purposes.

2 e The rights of way or parts thereof to be vacated are
described as follows:
11 G"-Sarah Alley between Florence Avenue and lfGt1 Street.
For further particulars as to the proposed vacation, refer-
ence is hereby made to the attached Exhibit 0 A0 •
3. That all proceedi1ogs for the vacation of such right of
way or parts thereof are intended to be and shall be taken sub-
ject to the following work:
a. Remove asphalt conc:tete transitions between the sub-
ject alley and Florence Avenue and 11 Gu Street travel
ways ..
b. Install full height concrete curb, gutter and sidewalk
at the "G" Street-alley intersection including neces-
sary asphalt concrete transition to effect the closure
of the subject alley to through traffic.
c. At the Florence-alley intersection, install one of the
following on the property line: a block wall, wood
fence or a 1-foot high concrete curbing with optional
fencing behind curbing to effect the closure of the
alley to through traffic.
l~.. The City of Fresno reserves and ext!epts from the sub-
ject vacation the permanent easement a.nd right at any time, or
from time to time, to construct, maintain, operate, replace,
remove, and renew sanitary sewers., water mains, storm drains
and appurtenant structures in, upon~ and over the rights of way
or parts thereof to be vacated and pursuant to any existing
franchises or renewals thereof,, or otherwise, to construct,
maintain., operate, replace, remove, renew and enlarge lines of
pipe, conduits, cables, wires, poles, and other convenient
structures, equipment and fi1letures for the operation ipf.gas
pipe lines, telegraphic and telephone lines, railr<)ad lines,
and for the transportation or distribut:ion of electric energy,
petroleum and its products, ammonia, water and incldental pur-
poses, including access to protect such wo1:ks from all hazards
in, upon, and over the rights of way or parts thereof to be
vacated.
5. That all proceedings for the vacation ,of such rights
of way or parts thereof are intended to be and shall be taken
subject to the foregoing resiervations and exceptions.

6. The City Clerk of the City of Fresno shall certify to
the passage o:E this Resolution and shall file a certified copy,
attested by the Clerk under the seal of the City of Fresno, in
the Office of the City Clerk of the City of Fresno, State of
Cali:fornia.
7.. That the Publ:i.c Works Director, upon certifying the
acceptance of the work specified above, shall d:i.rect the City
Clerk to record this Resolution ..
8. That this vacation shall become effective on the date
of recordation of this Resolution ..
