FRESNO, CALIFORNIA, APPOINTING ENGINEER
AND .P.1.TTORNEY FOR CIT2' OF FRESNO ASSESSMENT

WHEREAS, this Couti.cil has Ct:>mmenced proceedings pursuant
to appropriate special assessment and assessment bond acts for the
acquisition and financing of public improvements in the City· of
Fresno; and
WHEREAS, the public interest and gen,eral welfare will be
served by appointing and employing an engineer and an attorney for
the preparation and conduct of such proceedin1~s and work in con-
nection with such acquisitions.
NOW, THEREFORE, THE COUNCIL OF THE! Ci TY OF FRESNO DOES
HEREBY RESOLVE AS FOLLOWS:
l. James L. Martin, Public Works Director of the City
of Fresno, California, is hereby appointed as Engineer of Work to
do and perform all services in making prelimin~:1cry surveys, prepa1:--
ing plans, estimate of cost and diagram and assessment, and his
compensation, exclusive of inspection, surve•rr .1. I and other costs
already incluaea in the project cost pursuant to acquisition
agreements, is hereby fixed at ten and one half percent (10 1/2%}
of the total assessm,=nt.
2. James A" McKelvey, City Attorney for the City of
Fresno, California, is hereby appointed and employed to do and
perform all legal services required in the conduct of such pro-
ceedings, including any court proceedings for the determination of
damages for the works and improvements, and his compensation is
hereby fixed at two percent ( 2 % ) of the total assesi>ment.
3. The compensation of the Engineer of Work, the costs
and expenses of construction engineering and inspection, and thE~
attorney's fees shall be included as incidental expenses of the

proceedings, and shall be~ assessed as directed in the Resolution
of Intention to be adopted in the proceedings: ..
