HomeMy WebLinkAboutResolution - City Council - 82-472 - 1982-10-05• • RESOLUTION NO. 82-472 A RESOLUTION OF THE COUNCIL OF 1rHE: ,CITY OF FRESNO, CALIFORNIA, PRELIMINARILY DETERMINING THAT PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE IMPROVEMENTS OR ACQUISITIONS HEREIN GENERALLY DESCRIBED; SETTING TIME AND PLACE OF HEARING FOR DE'l~'.ERMINING PUBLIC C0NVli:NIENCE AMD NECESSITY FOR THE CONSTRUCTION OR ACQUISITION OF SUCH "SPECIAL ASSESSMENT INVESTIGATION, L!M!TATI0N AND MAJORITY PROTEST ACT O~ 1931"; AND DIRECTING NOTICE IN THE MATTER OF CITY OF FRESNO ASSESSMENT DISTRICT NO. 88 Pub l i c Works WHEREAS, by its Resolution No • 8 2 -if,_1 __ this Council has approved a map of a proposed special assessment district designated "CITY O.~' FRESNO ASSESSMENT DISTRIC'r NO. 88lJ, the ex- terior boundaries of which proposed district are as shown on such mapi and 1?7HEREAS, such map is on file with the City Clerk as part of said Resolution No,. 82 -JlZL-; and .WHEREAS, the area within the proposed district includes those pror{erties generally along the west side: of Frest10 Street i and Herndc n Avenue on the north and by Bullard Avenue on the south1 and WHEREAS, it appears that the publi1~ convenience and necessity require that improvements or acquisitions within such area be made as hereinafter described and that the co5ts and e,c.- penses thereof be made chargeable upon an assessment district bounded as above described; and WHEREAS, it appears that such assessment proceedings should be taken without complying with the provisions of the ''Special Assessment In-vestigation, Limitation and Majority Protest Act cif 1931 11 ; NOW, THEREFORE, THE COUNCIL OF THE CITY OF l:i"RESNO DOES HEREBY RESOLVE, FIND, DE 1rERMINE i~ND ORDER AS FOLLOWS: 1. The Council preliminarily determines that the public convenience an.a necessity require that the improvements or .. .. • acquisitions hereinafter described phall be nHitde, and th1~ cost and ,r expense. thereof be paid for by special assessments levied upon the property within the district benefited there:by and by contribu- tions from the City of Fr;esno 01: any other authorized source, and that all necessary proceedings therefor should be taken without complyin(~ with the provisions of the nspecial Assessment ·1nv-esti- gation Limitation and Majority Protest Act of l93lu. 2. The boundaries of the proposed a~isess:ment district are shown on the map of nproposed Boundari1es City of Fresno· Assessment District No. 88.,, approved by Resolution No. 88 -471 1 lff.t!_~- of this Council and on file with the City Clerk of the City ,of Fresno, and il1clude those properties generally along the west side of Fresno Street and bounded by Herndon Avenue on the north and by Bullard Avenue on the south. 3. The improvements to be constructed or acquired are generally described a~; follows; Construction and installation of approximately 4812 1 ineal feet of 48 inch reinforced concrete pipe along the westerl~~l side of Fresno, Street between Bullard Avenue and Hern.d<:>n I\.venue, · vent pipes,, stand pipes, tret?,ching, resurfacing where required; the doing Cif all transition work and the construction and acquisi-• tion o:E all improvements and rights-of-way au.xiliary to any of the foregoing and necessary to carry out same in accordance with the requirements of the City of Fresno. 4. NO'J!ICE IS HEREBY GIVEN that Ttlesday, the 26th day of October, 1982, at the hour of 2::00 P.M .. in the regular nH~eting place of th:Ls Council, Council Chamber, City Hall, 2326 Fresno Street, Fresno, California, is fi1{ed as the time and place when and where any and all pers<::>nit) .inb~rested may. appear and show cause, if any they have, why this Council should not finally find and determine that the public convenience and necessity require the proposed improvements and acquisitions without compliance with -2- "' • • the '1 Special Assessment Investigation, Limi.tat:i.on and Majority Protest Act of 1931". Any person interested may at such time and place object to the undertaking of such procE~edings without first complying with the provisions of the Investigation Act. 5. The City Clerk is directed to publish a copy of this Resolution twice in the Fresno Bee a newspaper of gE~neral circula- tion published and circulated in the City of Fre:sno, the first publication to be completed at least ten (10.) days before the day of the hearing, as hereinabove set forth .. * * * * CLERKlS CERTIFICATE I, JACQUELINE L.
