REPORT AND APPOINTING TIMFl AND PLACE OF HEARING
PROTESTS IN THE MATTER OF CITY OF FRESNO

RESOLVED, by the Council of the City of Fresno, Cali-
fornia, that;
WHERl3!AS, on the 5th day 0 1£ october, 1982, said council
did adopt its Resolution oj; Intention to order acquisitions to be
made in said City and to make the costs and expenses thereof
chargeable.upon an assessment district; and did refer the proposed
acquisitions to the Engineer of Work of said District, and did
direct said Engineer of Work to make and file with the City Clerk
of said City a report in writing, as :more particularly described
in said resolut.ion, pursuant to Article 20" Chapter 15, of the
J.t'resno Municipal Code; and
WHEREAS, said Engineer of work has made and filed with
the City Clerk of said City a report in writing as called for in
said Resolution of Intention, which report has been presented to
this Council for consideration-; and
WHEREAS, said Council has duly considered said report
and finds that each and every part oi: said report is sufficient,
and that neithet.· said report, nor any 9art thereof, requires or
should be mod:i.fic➔d in any resJ.?•~ct,.
NOW, THEREFORE, IT IS ORDERED, AS FOLLOWS:
l,. That the description of the pro,posed acquisitions
to be made, contained in said report bE~, and they are hereby, pre-
liminarily approved and confirmed.
2. That th~ Engineer• s estimate of the costs and ex ...
penses of the acquisitions and of the :lncidental expenses in con-
nection therewith;, contained in said report, \be, and eacJ-i of them
is hereby, prelim:i.narily approved and confirme•d.

3. That the diagram showing the assessment district
referred to and d1esct·ibed in said Resolution of Intention and also
the boundaries and dimensions. of the respective subdivisions <:>f
land within said assessment district as the s~tme existed at the
time of the passage of said Resolution of Intention, each of which
subdivisions has been given a separate number upon such diagram,
as contained in said report, be, and it is hereby, preliminarily
approved and confirmed~
4. That thE~ proposed assessments upon the several sub-
divisons of land in sa.id assessment district, in proportion to the
estimated benefit~; to be received by, such sub:1ivisions, respec~
tively, from said acquisitions and of the incidental expenses
thereof, as contained in said report, be and they are heri~by, pre-
1 iminaril y approved and confirmed.,
5. rrhat said report shall stand a.s the Engineer's
Report for· the purpose of all subsequent proceedings and pursuant
to said Resolution of Intention.

the hour of 2 :00 l'.M., in the regular meeting place cif this
Council, Council ChambeJ:s, City Hall., Fresno 1 California, be and
the same are hereby f i}:ed as the time and place when and where
this council will hear and consider protests to the proposed
acquisitions, the extent of the assessment district, or to the
proposed assessment. Any interested person may object to the pro-
posed acquisi tioris the extent of the assessment district, or the
proposed assessmE~nt, by filing a written protest with thf~ city
Clerk at or befot·e said time set for hearing, and said City Clerk
shall endorse on each protest the date of its receipt and at s3'ii!
time fixed for said hearing, shall pr,esent to the Council all pro-.
tests filed with said City Clerk.

7.. ¥!'he Department of Public Works {Consulting Services
Division) of the City of Fresno is, designatE~d as the City
Department to answer inquiries regarding the prote:~t. proceedings.
8. The City Clerk of this City is hereby directed to
give notice of said hearing on the Resolution of Intention and
Engineer's Report by publications tv1ice in the Fresno Bee, a news-
paper of general circulation published and cir.,ulat1ed in said
City, and by conspicuously posting a notice thereof al<::>ng all the
open streets within the assessment district at not more than three
hundred (.300) feet apart, and not less than three (3) in all, said
posting and fi:rst publication to be had and completed at least ten
(10) days before the date therein set for hearing of protests.
Said posted notices shall be headed "Notice of Improve-
ment" in letters of not less than one-half inch (1/2") in height
and shall.,, in legible characters, state the fa,~t and date of the
passage of said Resolution of Intention and of the filing o.f said
gngineer's Report, and of the date 1 hour, and pl.ace set for the
hearing of said protests, briefly describe the improvements and
acquisitions proposed to be made, refer to said Re 9 olution of
Intention and the Engineer's Report for further part:iculars, and
state the name and telephone number of the City Depa:rtment desig-
nated to answer inquiries regarding the protest proceEedings.
9. The Clerk shall mi::1.il or cause to be mailed notice of
the adoption of said Resolution of Intention and the filing of
said report, posta.ge prepaid, at least ten ( 10) days before the
date set for hearing of said protests, to all persons owning real
property to be assessed, whose names and addresses appear on the
last equalized assessment roll for City taxes prior thereto or as
known to the Clerk:, which notice shall contain a statement of the
time, place and purpose of the hearing on said Resolution of
Intention, and report, a statement of the total estimated cost of

the proposed improvements, and acquisitions, and the a.mount., as
shown by said report, to be assessed against the particular parcel
covered by the notice, a statement that any person interested mc,y
·file a protest in writing as provided in said code, and a state-
ment of the name and telephone number of the City Department
designated to answer inquiries regarding the protest proceedings.
