A RESOLUTION OF THE COUNCIL OF THE CITY OF
FRESNO»' CALIFORNIA, APPOINTING ENGINEER

WHEREAS, this C<>t1ncil has commenced proceedings pursuant
to appropriate special assf~ssment and assessment bond acts for the
acquisition and financing of public improvements in the City -c~f
Fresno; and
WHEREAS, the public interest and general welfare will be
served by appointing and employing an engineer and an attorney for
the preparation and c:onduct of such proceedings and work in con-
nection with such acquisitions.
NOW, THEREFORE, THE COUNCIL OF ~HE CITY OF FRESNO OOES
HEREBY RESOLVE AS FOLLOWS:
l. James L. Martin, Public Works Director of the City
of Fresno, California, is hereby .appointed as Engineer of Work to
do and pei~form all services in making preliminary surveys, prepar-
ing plans, esth'nate of cost and diagram and assessment, and his
compensation, exclusive of inspection, snrvey, and other costs
already included in the project cost pursuant ,to acquisition
agreements, is hereby fixed at not to exceed three percent (3%) of
the total as:sessment,.
2. James A. McKelvey, City Attorney for the City of
Fresno, California, is hereby appointed and employed to do and
perform all legal services required in the conduct of such pro ....
ceedings, including any court proceedings for the determination of
dam,ages for the workJ:;; and improvements, and his compensation is
hereby fi: -ed at two percent (2%) of the total assessment.
3. The compensation of the Eng:lneer of work, tlne costs
and expenses of .. construction engineering and it1spection, and the
attorney's fees shall be included as incidental expenses. of the
