FRESNO DETERMINING TO UNDJfRTAKE PROCEEDINGS
PtlRSUl\.NT TO SPECIAL ASSESSMENT AND ASSESSMENT
BOND ACTS FOR THE ACQUISITION OF IMPROVEMr}~TS
WITHOUT FURTHER PROCEEDINGS UNDER DIVISION 4

RESOLVED, by the CounciJ. of the City of Fresno, County
of Fresno, California, that
WHEREAS, a written petition for undertaking proceedings
pursuant to special assessment and assessment bond acts, and to
assess the cost ther,eof upon the properties benefited, and waiving
proceedings under Division 4 of the St~:-eets and Highways Code,
signed by the owners of more than 60% in the area of tbe proper-
ties proposed to be assessed, has been filed with the City Cle~"k
for the acquisition of: improvements described on Exnibi t "An
attached hereto and made a part he1:eof;
WHEREAS, the costs and expenses of said acquisitions and
imp1::-ovements are to be chargeable upon an assessment district, thie
exterior boundarie~ of which are the coter11tiinous exterior bounda-
ries of the coroposi te and consolidated area shown on the map
thereof on file in -the off ice of said Clerk, to which l:'efet'ence is
hereby made for further particulars;
WHEREAS 1 said proceedings are in whole or in pa:ct for
the acquisition of streets and easements initiat-ed under a con-...
tract entered into or proposed to be entered into betwe,en a sub-
divider and the City of Fresno pursuant to Section 66462 of the
Government Code, and the evidence and certificate required to be
submitted and furnished by Sections 2804.l and 2804.2 of the
streets and Highways Code have been submitted and fi1rnished;
WHEREAS, the public interest and convenience will be
served by the taking of said proceedings;

NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND
ORDERED as follows:
l • That all of the owneirs of more than 60 % in area of
the property subject to assessmt~nt for said acquisitions and
improvements who appear to be such on the .Assessor 1 s roll on the
day that said petition was filed, or, in the case of transfers of
land or parts thereof subsequent to the date. upon which the last
Assessor's roll was prepared, appear to be such on the records in
the County Assesse>r's office which the County Assessor will use to
prepare the next ensuing Assess;or• s roll, and including owners as
defined in Section 2804.2 of the Streets and Highways Code, have
signed ana filed with said Clerk a w:r:itten petition for said
acquisitions and improveme11ts and a written waiver of investiga .. ,..
tion proceedings under Division 4 of the Streets and Highways
Code.
2. 1rhat the total estimated amottnt of the proposed
assessment for the portion of said acquisitions and imp:ro'vement.s
which are improvements of streets and easements initiated under
said contract pursuant to Section 66462 of the Government Code
will not exceed 75% of the estimated fair market value of the land
proposed to be assessed therefor after the pr,oposed public
improvements have been constructed, and that there has been strict
compliance with the requirements of Sections 2804.1 a:nd 2804 •. 2 of
the Streets and Highways Code.
3. That the provisions of Division 4 of the Streets and
Highways Code, other than those which relate to the foregoing
findings, determinations and orders, shall not apply to the making
of said acquisitions and improvements, and proceedings therefor
shall be had pursuant to the Municipal Impro~rement Act of 1913 and
bonds shall be issued pursuant to the Improvement Bond Act of
1915, -without further proceedin9s under said Division 4.
