WHEREAS, this proposal is made pursuant to the District Reorganization Act of 1965 contained in Division 1 of Title 6 (commencing with Section 56000) of the California Govern- ment Code; and WHEREAS, the nature of the proposed change is a reorgan- .;i.zation consisting of the detachment of certain territory consisting of 5.19 a.cres and hereinafter called the 11 subject territory" from the Mid Valley Fire :Protection District and the Kings Riv-er Conservation District, and annexation of the same territory to the City of '.B"'reisno; and WHEREAS, no other counties, cit:Les, or districts are affected· and . -, WHEREAS, the proposed reorganizntion is uninhabited, is described in Exhibit. '' A II and graphically depicted in Exhibit ''B"; and WHEREAS, the Master Service Delivery Plan, adopted by the Council on November 13, 19 7 9, prE~pared in accordance with Government Code Section 35102, provides information for the City of Fresno,, s plans and pc;)licies for the pro- vision of services in the metropolitcin area; and WHEREAS, pursuant to Resolution No. 80-172, the Council has approved the implementation of the Master Service Delivery Plan; and WHEREAS, the Master Service Del::i.very Plan specifies City plans and policies for the provision of services to the sub- ject territory; and Page 1 of 3 Ed Bielicki • • WHEREAS, review and analysis of gnvironmental Assess- ment No.· 3174, relating to the Master Service Delivery Plan has resulted in the filing oJ: a Negative Declaration by the Director of the Development Department; and WHEREAS, no new districts are pxoposed to be formed by this reorganization; and WHEREAS, the Fresno County Assesisor • s roll will be used for the purpose of levying any assessments or taxes on the subject territory; and WHEREAS, the :subject territory proposed to be annexed tc, the City of Fresno will be exemptisd from taxation for payment of principal or interest, or any other amounts which shall become due on account of any outstanding bonded indebt- edness incurred by the City prior tc, the effective date of such annexation, and upon completion of this :teorganization proposal, the subject territory will be included in Municipal Bond Area 11 D" and will not be taxed for any existing bonded indebtedness or contractual obligat;Lons; and WHEREAS, the reasons for this proposal are stated as follows: 1. Annexation of the subject territory to the City of Fresno will result in improved land use planning. All p:ri vate development con,.. trols of the City will apply, following re- organization. 2. The subject territory is within the City of Fresno's Sphere of Influence .. 3. The territory is subject to a contract wherein property owners have agreied to consent to annex- ation to the City of Fre~ino in exchange for the City's agreement to extend municipal water services to the property. 4.. It is advantageous fox· the subject territory to be a pa.rt of the City. Page 2 of 3 • • NOW I THERlt~FORE, BE IT RESOLVltD that the Council of the City of Fresno he:r:-eby requests that proceedings be taken by the Fresno Local Agency Formation Co:rnmi.ssion for the herein proposed Turner-Garden No .. 1 Dist:rict Reorganization, including the detachment of the s:ubject territory, consis,t- ing of 5.19 acres from the Mid Valley Fire Protection District and the Kings Eiver Conservation District, and annexation of the same territory to the City of Fresno;' and BE IT FURTHER RESOLVED that the Council of the City of Fresno finds Environmental Assessment No. 317 4 is the c1:>n- trolling environmental document for this anne$:ation pro- posal, such environmental assessment has been completed in compliance with the California Environmental Quality 1\.ct and the State Guidelines, and the Council has reviewed and considered the information contained in such environ- mental assessment prior to the app.roval of the initiation of this annexation proposal and fi:nds there is no poss,... ibility such proposal may have a s.Lgnificant effect on the environment.
