RESOLUTION NO. 82-453
A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO
CERTIFYING FINAL ENVIRONMENTAL IMPl\,CT REPORT NO.
10075 AND CONTAINING FINDINGS REGARDING SIGNIFICANT
EFFEC'J!S IDENTIFIED IN :&,INAL ENVIRONM.l!!NTAL IMPACT
REPORT NO.. l 0-07 5 r RELAIJ~ING TO THE: liROPOSED PINEDALE
BUSINESS PARK
WHEREAS, Final Environmental Impact B!eport No. 10075 relating
to the Proposed Pinedale Business Park which consists of the Hern-·
don-Ingram Amendment of the Woodward Park Community Plan, Amend·-
ment of the San Joaquin Bluffs Specific Plan, Tentative Tract Map
Noo 3514, Urban Growth Management Application No. 150, and Rezon-
Application No. 6675, has been prepared in compliance with the
California Environmental Qua.lity Act; and
WHERE:AS, Final Environmental Impact Report No. 10075 has been
presented to the Council of the City of Fresno for review and con-
sideration.
NOW, THEREFORE, BE IT RESOLVED the Council of the City of 12,resno
certifies that Final Environmental Impact Report No. 10075 ha.s been
completed in compliance with the California Environmental Quality
Act, the State CEQA Guidelines, and the City of Fre:sno• s Environ-
mental Quality Ordinance, and the Council has reviewed aL.d considered
the information contained therein.
BE IT FURTHER RESOLVED, the Council finds certain mitigation
measures which will mitigate or avoid significant adverse effects
on the identified in Final Environmental Impact Report No,. 10075
have been incorporated into the project.
A. GENERAL
1. Conduct df~tailed soil and foundation studies to
provide diasign infox:mation which will avoid po-
tential hazards inherent with the abandoned
land£ ill site and sewage ponding basins in th1e
northerly poJ:tion of the pr<>ject site.
2. Avoid potential soil erosion during site grading .•
3. Periodically sweep parking areas to reduce the
introduction of pollutants into storm water and
ponding basins.

B. NOISE
1. Review loading dock locationts in the site plan
and conditional use permit rEi'!View p:t·ocesses to
ensure adequate distances :Er<:>m residences and
the effective location of solid masonry walls
on the property lines betwee1:1 commercial loading
docks and residentially zoned prope:tty.
2. Shield roof mounted air condi.tionini; equipment
or place such eqUipment behi:nd parapet walls to
mitigate the effects of nois•e on a.djace:n.t resi-
dential areas.
C. ENERGY CONSUMPTIOJ'.~
1. Before demoli ti.on, analyze existin<,:;r i11.dustrial
buildings to determine the feasiblJLity of recla-
mation of materials or reuse of thE:!. buildings to
reduce the loss of energy embodied. in original
manufacture and erection.
2. To reduce energy consumed in the operation of com-
mercial and office buildings,, analyze building de-
signs to determine optimum Emergy conservation and
acceptable life cyC!le costs,
3. Prohibit $xterior architectural lighting ..
4. Provide automatic controls for exterior area light-
ing.
5. To reduce energy consumed i'n aver,age daily vehicle
miles traveled, implement mitigation measures recom-
mended to reduce traffic impacts, listed under "D 11
below.
D. TRAFFIC AND AIR QUALITY
1. PHASE ONE
a. Construct Herndon Front.age Road with curb,
gutter, sidewalk, island curbr and 42 feet
of pavement from Harriso!n to 15 0 feet to
east of Harrison with appropriate termina-
tion providin9 driveway accee;~~ to Lot 1.

• Close remainder of fron·::.age road from 150
feet east of Harrison to Palm Avenue.
b. Remove the north curb and gutter of Herndon
Expressway from approximately 1000 feet
east of Palm to approximately 500 feet west
of Harrison. Reconstruct curb and gutter
at a new alignment to provide three west-
bound lanes, a right turn lane and a hus
bay¥ at Palm. Construct pavement from the
new gutter line to meet existing pavement,
plus transition paving at both ends of the
widened section-
c. Reconstruct the Herndon Expressway median
island east and west of Palm to provide two
eastbound and westbound left turn lanes
with appropriate transiti.ons.
d. Acquire right-of·-wa:v for a (maximum) 110
feet street; remove and reconstruct the
curb and gutter on the west side of Palm
from Herndon south approximately 400 feet;
and construct curb and gutter on the east
side of Palm from Hernd.011 to the existing
imprc,vements .141 feet n1;:>rth of Magill.
e. Reconstruct the Palm Av1enue median island
from Herndon to approximately 140 feet
north o:f Magi 11 to provide for two north-
bound left turn lanes at. Herndon.
f. Modify the traffic signntl ·controller and·
equipment at the inters<actic,n of Palm and
Herndon to provide for left turn phasing
and double left turn in<.iications in all
directions.
g. Widen the He~ndon frontcage road to· 44 feet,
curb to curb, from Harrison to Fruit in-
cluding construction on a new alignment
from a point on the fro::itagE~ road app:i;,oxi-

k. Modify the traffic signal: equipment at the
intersection of :&"'rui t and• Herndon as necessary
to provide for t'.he double left turn lanes and

l. Acquire right-of·-way to WD.-den Nees Avenue fJ:om
Ingram to Blackst<:>ne to 106 feet. Construct
median island a.nd additional paving to pro-
vide a four-lane divided 'istreet with left turn
pockets and a shoulder on; the south side. (UGM)
m. Modify the traffic signal equipment at the in-
tersection of Blackstone and Nees to provide
for the widening of Nees.
2. PHASE TWO
I
a. Abandon and close the reu~aind-er of Herndon
Frontage Road between Pa.\m and the point of
which Locust Avenue merg{~s into the Herndon
Frontage Road.
b. Acquire the necessary ri9:ht.-of-way, and widen
the Herndon Frontage Roai!l, to connect to Hern·-
don Expressway at Maroa .~venues, providing a
64-foot minimum roadway from Ingram to Maroa~
In conjunction with this requirement, terminate
by cul-de-sacing, Maroa north of Herndon and

the He.rndon ]1 rontage Ro~d east of Maroa. In
lieu of this requirement, the subdivider may
connect the two streets :by connecting them
with a new roadway ..
c. Remove the north curb an,;l gutter of the Herndon
Expressway from app:toxim<itely 1000 feet east
of Maroa to 1000 feet ea:?t of Palm. Reconstruct
curb and gutter at a new;alignment to provide
three westbound lanes, a right turn lane, and
a bus bay at Maroa.. Conintruct pavement from the
new gutter line to meet eixistlng :pavement, plus
transition paving at the east end of the widened
section. 2.\.lso close the 'front.age road opening
onto Herndon Expr~ssway at Ingram. This require-
ment completes the widening of Herndon from east
of Maroa to west of Harrison in conjunctioxi with

d. Relocate and augment. the. traff:ic signal equip-
ment from Herndon and Ing:r:am to Herndpn and
Maroa to provide fcir a full four-way intersec-
tion with eastbound and WE~Stbottnd left tu:rn
phasing.
e .. Install traffic signals at. the intersection of
Maroa and Sierra.
f. Modify the traffic signal controller and equip-
ment at the int.ersection oJ: Eu11,rd and Maroa

to provide for protested. l,eft turns.
3 • PHASE THREE
a. Construct the center two lanes <)f Nees Avenue
from Blackstone to Fresno J~venue plus left turn
lanes at the major street :Lntersections.. {UGM)
b.. Mod.ify and augment the tra:f fie signal controller
and equipment at the intersectic>n of Blackstone
and Nees to provide for the fou:c-way intersec-
tion and left turn phasing northbound and south-
bound. Comply with all requirements of applica-
ble Caltrans encroachment permit. (UGM)

4 .. 0THER STREET IMPROVEMENTS; to ensure the effective-
ness of measures incorporated into the project to
mitigate project related 1~ffect1:; on traffic and air
quality, other street imp~:-ovements rt;!quired for
Tentative Tract Map No. 3~i14 by ·t:he Development
Department memorandum date1d July 29, 1982, shall be
incorporated into the proj!ect as appropriated to
each phase of development.
5. OTHER TRAFFIC R:E!Ll\TED MEAS::]RES
a. Extend transit rou.tes through the project site.
b. P:rovide bus stop pull outs at strategic loca-
tions within the projec1t site ..
c. Post transit routes and scheudles at bus stops
within the project site,.
d.. Investigate additional ~~ast-we~st transit routes
north of Herndon Avenue •.
e. Shorten headway time between buses serving the
project site ..
f. Limit the number of parklng lot access points
on the on-site street syt~tem.
g.. Prohibit on-street parki:rig on the on-site streets.
h. Encourage employee car pc,oling.

a. Water exposed, dry, tQp soil and dust producing
areas during d(~molitio.n, site grading, street
construction, and building construction to re-
duce airborne particulate matter.
b. Stabilize f inish.ed soil areas by the timely
planting of land.scaping to reduce airborne
particulate matte\r ..
c. Limit the number of drive-up windows for com-
mercial use to reduce carbon monoxide emission
rates.
7. STORM WATER DRAINAGE
a. Storm water drainag,,e; comply with the provisions
of the Fresno Munic;Lpal Cod,~~.
BE IF FURTHER RESOLVED the Coun~iil finds the completion of
Freeway 41 north of Bullard Avenue to the San Joaquin River will
facilitate access to the project site and is the responsibility of
the California State Department of Trai~sportatlon, and such miti-
gation measure can or should be adopte~. by s1..1ch agency.
BE IT FURTHER RESOLVED the Council finds the adverse effects
on the environment associated with the a.lternative regional shopping
center complex project are greater than the adverse effects asso-
ciated with the proposed business park.
BE IT FURTHER RESOLVED the Council finds the consideration of
alternative sites for regional shopping center development, the
locations of which are North Blackstone and East Alluvial Avenues,
East Shaw and North Clovis Avenues, and East Kings Canyon Road and
South Willow Avenues are not appropriate alternative sites for the
Proposed Pinedale Busine,ss Park and are theri~fore infeasible ..
BE IT FURTHER RESOLVED the Council finds'. the No Project Alterna-
tive is not a suitable or productive use of the project site, con-·
sidering the impending discontinuation of tht~ use of a large portion
of the project site and the improved major str~et circulation system
resulting from the project,, and that the No P:roject Alternative is
therefore financially infeasible.
