A RESOLUTION OF THE COUNCIL OF 1J~'HE CITY OF FRESNO,
CALIFORN'-:IA REINSTATING A MORATO~RIUM ON THE PROCESSING,
REVIEW, APPROVAL OF DEVELOPMENT;: ENTI1'LEMENTS FOR
CERTAIN PROPERTIES LOCATED WITHJN THE SOUTrlWEST FRESNO
GENERAL NEIGHBORHOOD RENEWAL AruiA PROJECT
WHEREAS, on February 16, 1982, i:J1e Council of the City
of Fresno initiated the public review:and hearing process
for proposed amendmentE; to the S01,.tthw1pst Fresno General
Neighborhood Renewal Area {GNRA} Proj ~~ct Urban Renewal Plan,
and set April 13, 1982, as the date fc1r the joint public
hearing on the proposed amendments bef:pre the Redevelopment
Agency and Council of the ci:ty of Fresho; and
WHEREAS, the said public he~.ring date was contined to
April 27, 198.2; June 8., 1982; June 22,;1982; July 13, 1982;
August 3, 1982; September 14, 1982; ancf has subsequently
been continued to October 12, 1982; and.i 1
WHEREAS, the Council has determine<[ that a moratorium

on construction or developmer~t for cierte~in properties within
the Southwest Fresno GNRA Project (here9:fter referred to as
nThe Project Ai::-ean) is necessary to ensutr-e that the purposes
of the Community Redevelopment Law are nbt impaired during ,,
the period in which the proposed amendmej\lts are in the
process of public review and hearing,, anqa that properties

within the Project Area a.::-e not economic~illy or irreversibly
connnitted to uses which would be inconsis:tent with the
amendments as ultimately adopted by the qpuncil and the
Agency; and

WHEREAS, concurrently with. the initi~~tion of the said
public review and hearing proceiss:i, the Co1:inoil has adopted
Resolution No. 82-66 1 thereby establishin~r a moratorium
wherein no applications for any development entitlements for

certain properties within the Projiec:t Area, incl udir1g but
. . ' .
not limited to subdivisions, rezo1i;ings r special .permits,
building permits for new uses or eiXpanded uses or structures,
which are not in conformance with ~he proposed amendments,
shall be accepted, processed, or approved by the City of

Fresno; and
WHEREAS v on April 27, 1982, tl~e Council adopted Resolu-
tion No. 82-192, thereby extending the said moratorium for a
period of sixty (60) days; and
WHEREAS" on June 22 7 1982, the,, Council adopted Resolu-
tion No. 82-283, further extending ·t:he said moratorium for a
period of forty-five (45) days; and
WHEREASr pursuant to th~:l provi~tions of Resolution No.
82-283, the said moratorium expired.and was of no further
force and effect at 12:01 a .. m., on the 46th day following
the adoption of the said resolution.; and
WHEREAS, the continuance of the:public hearing date to
October 12., 1982, necessitates the re}instateme11t of the said
moratorium in order to maintain its ;purposes and intent ..
NOW, THEREFORE, BE IT RESOLVED, \by the Council of the
City of Fresno as follows:
1.. The moratorium established by Rei~olution No. 82-66,
relating to the processing review, approval of develop-
ment entitlements for certain pr~)perties located within ,. .
the Southwest Fresno Genera! Nei~rhborhood Renewal 1lrea
Project, as shown on the attached Exhibit 0 A'1

extended by Resolutions No. 82-192 and 82--·283, is

hereby reinstated, and shal.L remain in full force and.
effect until 12:01 a .. ml', on the 61st day following the
adoption of this resolution,, unless sooner rer::cinded.
