CITY OF FRESNO APPLYING TO THE F.RESNO LOCAL AGJ~NCY FORMATION COMMISSION IN THE MATTER OF THE•· PROPOSED TULARE- CLOVIS NO. 4-A DIS~JRICT REORGAN!CZ1~TION, IN- CLUDING THE DETACHMENT OF CERTA:tN TERRITORY CON- SISTING O:E"' 10 .16 ACRES FROM THE MJ:D VALLEY FIRE PROTECTION DISTRICT AND THJg KINGS RIVER CONSERVATION DISTRICT, AND ANNB1{AfJ.'fION OF SAID TERRITORY TO THE C!TY OF FRESNO WITHOUT ?~OTICE AND HEARING OR AN ELECTION~ WHEREAS, this proposal is made pursuant to the District Reorganization Act of 1965 contained in Division 1 of Title 6 (commencing with Section 56000) of the California Govern- ment Code; and WHEREAS, the nature of the proposed (:hangE~ is a reorgan- ization consisting of the detachment of c~~rtain territory consisting of 10.16 acres and hereinafter calLsd the "subject terri tory 11 from the Mid Valley Fire Prote~~tion District and the Kings River Conservation District., and annexation of the same territory to the City of Fresno;·and WHEREAS, the owner of all the land within said ter- ritory has been contacted and indicated that he may consent to such annexation depending upon his tenl;tnts desires; and WHEREAS, no other counties, cities, or diskricts are affected; and WHEREAS, the propo~;ed reorganization is inhabited, is described in Exhibit "A" and graphically depicted in Exhibit uB"; and WHE.REAS, the Master Service Deli very Plan, adopted by the Council on November 13, 1979, prepared in a.ccordance with Government Code Section 35102, provides in.formation for the City of Fresno' fl plans and policie~s fox-the pro- vision of services in the metropolitan are~a; and WHEREAS, pursuant to Resolution No.. ~I 0-172 1 the Council has approved the implememtation of the 1Vla~1ter Service Delivery Plan; and WHEREAS, the Master Service Delive1.·y Plan specifies City plans and policies for t.he provisions of siervices to the sub- ject territory; and Pagel 0f 4 • • WHEREAS, it is intended to obtain the property owners written consent for annexation and to process this proposal as a 100% consent project; and WHEREAS, review and analysis of .Environmental Assess- ment No. 3174, relating to the Master Service Delivery Plan has resulted in the fj_ling of a Negative Declaration by the Director of the Development Departmentw and WHEREAS, no new districts are proposed tQ be formed by this reorganization; and WHEREAS, the Fresno County llissessor: 1 s roll will be used for the purpose of levying any aSSt3ssments or taxes on the subject territory; and WHEREAS, the subject territory proposed to he annexed to the City of Fresno will be exempted j:rom taxation for payment of principal or interest, or any other amounts which shall become due on account of any outst:anding lJonded indebt- edness incurred by the City prior to the effective date of such annexation, and upon completion of this reorganization proposal, the subject terri tor:{ will be included in Municipal Bonded Area "D" and will not be taxed foi-any existing bonded indebtedness or contractual obligations; and WHEREAS, the reasons for this propo~tal are stated as follows; 1. Annexation of the subject territory to the City of Fresno will result in i:mproved land use planning. All private development con- trols of the City will apply, following re- organization .. 2. The subject territory is within the City of Fresno's Sphere of Influence. 3., 1rhe City of Fresno has initiated this proposal to comply with a LAFCO condition of approval applied to the proposed Tulare-DeWitt No,, 1 District Reorganization wherein recordation of said Tulare- DeWitt No. 1 Dist.riot Reorganization would be held in abeyance pending receipt of a City of Fresno application for annexation of the subject territory. It is advantageous fa'.)r thei subject territory to be a part of the City. NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Fresno hereby requests that proceedingz be taken by the Fresno Local Agency Formation Cornmi.ssion for, the herein proposed Tulare-Clovis No~ 4-A Distr:Lct Reor9tanization 1 includ- ing the detachment of the subject teJrritory, consisting of 10 .16 acres from the Mid Valley Fire Protecti,on District and the Kings River Conservation District:, and annexation of the same territory to the City of Fresno; and BE IT FUETHER RESOLVED, that upon receipt of the property owner's signed written consent for annexation. to the City of Fresno, staff will forward the signed "consent form 11 to the Fresno Local Agency Formation Conuniss1on .. BE IT FURTHER RESOLVED that the Counci1 1 s application in- clude a request for approval and auth<>rization from the Fresno Local Agency Formation Commission for the Council to annex the subject territory without notice ctnd hearing or an elect.ion. BE IT FURTHER RESOLVED that the Council. of the City of Fresno finds Environmental Assessment No. 3174 is the con- trolling environmental document for thi.s annexation pro- posal, such environmental assessment h~:1.s been c<:>n1pleted in compliance with the Californiat Envi:t:onmental Quality Act and the State Guidelines, and the Council has reviewed and cc)nsidered the information contained in such environ- mental assessment prior to the approval of the initiation of this annexation proposal and finds there is no poss•- ibili ty such proposal may have a significant effect on the environment.
