RESOLUTION OJ? THE COUNCIL OF THE :CIT'¥ OF
FRESNO APPLY'.rNG TO THB FRESNO LOC;AL AGENCY
FORMATION COM.MISSION IN THE MA'rTER OF iJ~HE
PROPOSED OLIVE-HELM NO. 3 DISTRICT
REORGANIZATION, INCLUDING THE DE1~CHMENT
OF CERTAIN TERRITORY CONSISTING a,r .30.4~~
ACRES FROM THE MID VALLEY FIRE PRbTECT-
ION DISTRICT AND THE !<INGS RIVER CONSERVA-
TION DISTRICT, AND ANNEXA,TION o:F SAID TER-
RITORY TO THE CITY OF FRESNO.
WHEREAS, this proposal is made, pursuant to the District
Reorganization Act of 1965 contained in Division 1 of Title
6 (commencing with Section 56000) of the California Govern-
ment Code; and
WHEREAS, the nature of the proposed change is a reorgan-
ization consisting of the detachment of certain territory
consisting of 30.43 acres and hereinafter called the "subject
t.erritoryn from the Mid Valley Fire Protection District
and the Kings River Conservation District, and annexation of
the same territory to the City of Fresno; and
WHEREAS, no other counties 1 cities, or districts a.re
affected; and
WHEREAS, the proposed reorganization is inhabited,
is described in Hxhibit "A 11 and graphically depicted in
Exhibit "B"; and
WHEREAS, the Master Service Delivery Plan, adopted by
the Council on November 13, 1979, prepared in accordance
with Government Code Section 35102, provideiS information
for the City of Fresno's plans and policies for the pro-
vision of services in the metropolitan area;; and

WHEREAS, pursuant to Resolution No. 80-172, th·e Council
has approved the .implementation of the Mast;.er Service Delivery
Plan; and
WHEREAS, the Master Service Delivery Plan specifies City
plans and policies for the provision of se~~vices to the sub-
ject territory; and

WHEREAS, review and anaJ.ysis o:l: Environmental Assess-
ment No. 3174, relating to the Master Service Delivery
Plan has resulted in the filing of a Negative Declaration
by the Director of the Development Departmenti and
WHEREAS, no new districts are proposed to be formed
by this reorganization; and
WHEREAS, the Fresno County Assesso!t'11 s roll will be

used for the purpose of levying any assessments or taxes on
the subject territory; and
WHEREASi, the subject territory proposed to be annexed
to the City ()f Fresno will be exempted from taxation for
payment of principal or interest, or any other amounts which
shall become due on account of any outstanding bonded indebt-·
edness incurred by the City prior to the effective date of
such annexation, and upon completion of this-reorganization
proposal, the: subject territory will be included in Municipal
Bond Area non and will not be taxed for any existing bonded
:i.ndebtedness or contractual obligations; and
WHEREAS, the reasons for this proposal are stated as
follows:
1.. Annexation of the subject te1:-ritory to the
City of Fresno will res,llt in. improved land
use planning. All private deivelopment con-
trols of thE~ C:i.ty will apply, following re-
organization.
2. The subject. territory is within the City of
Fresno's Sphere of Influence ..
3. The proposal is being initiated in response to a
LAFCO condition for approval applied to Bremer-Willow
No. 1-A District Reorganization, whereby recordation
of said Bremer-Willow No. 1-~.h would be held in abeyance
pending receipt of an an:nexa·t~ion proposal for the subject '.
territory.,
4. It is advantageous for the subject territory to
be a, part of the City.

NOW, THEREFORE, BE IT RESOLVED that the Council of the
City of Fresno hereby requests that proceedings be taken by
the Fresno Local Agency Formati()n Commission for the herein
proposed Olive-Helm No. 3 District Reorganization,
including the detachment of the subject territory, consist-
ing of 30.4.3 acres from the Mid Valley Fire Protection
District and the Kings River Conser,ration District, and
annexation of the same territory to the City of Fresno; and
BE IT FUR'!'HER RESOLVED that thE~ Coun<:: il of the City
of Fresno finds Env·ironmental Asses~~roent No. 3174 is the con-
trolling environmental document for this annexation pro-
posal, such environmental assessment:: has been co1npleted
in compliance with the California Environmental Quality
Act and the State Guidelines, and the Council has reviewed
and considered the information contiained in such environ-
mental assessment prior to the appri:,val of the initiation
of this annexation proposal and finds there is no poss-
ibility such proposal may have a significant effect on
the environment.
