RESOLUTION OF THE COUNCIL OF THE CITY OF
FRESNO APPLYING TO THE Ft:tESNO LOCAL AGENCY
FORMATION COMMISSION IN VJ:1HE MP .. TTER OF THE
PROPOSED BELMONT···THIRD NO.. 1 DISTRICT
REORGANIZATION, INCLUDING 'l?HE DETACHMENT
OF CERTAIN TERRITORY CONSISTING OF 85 .. 78
ACRES FROM THE MID VJ~LLEY FIRE :!?ROTECT-
ION DISTRICT AND Tl-IE KINGS RIVER CONSERVA-
TION DISTRICT I AND ANNEXMl.1ION OF SAID TER-
RiiJ:IORY TO THE CITY OF FRESNO.
WH:EREAS, this proposal is made pursuant to the Distric:t
Reorganization Act of 1965 contained in Division l of Title
6 (corome~ncing with Section 56000} of the California Govern-
ment Code; and
WHEREAS, the nature of the proposed change is a reorgan-
ization cons:i.sting of the detachment 'of certain territory
consisting of 85.78 acres and herein.after called the nsubject
territory" from the Mid Valley Fire PJ::-otection District
and the Kings River Conservation D:i.st:i:rict, and annexation of
the same territory to the City of Fres,no; and
WHEREAS, no other counties, cities, or districts are
affected; and
WHEREAS, the proposed reorganizat:ton is inhabited,
is described in Exhibit 0 A0 and graphically depicted in
Exhibit "B"; and
WHEREAS, th.e Master Service Deli ve1~y Plan, adopted by
the Council on November 13, 1979, prepared in accordance
with Government Code Section 35102, provides information
for the City of Fresno's plans and policies fcir the pro-
vision of services in the metropolitan ax·ea; and
WHERE~S, pursuant to Resolution No. 80-172, the Council
has approved the implementation of the Ma1;ter Service Delivery
Plan; and
WHli!RE1~S,, the Master Service Delivery Plan specifies City
plans and policies for the provision of services to the sub-
ject territory; and

WHEREAS, review and analysis of Environ:mental Assess-
ment No. 3174, relating to the Master s~~rvic,e Delivery
Plan has resulted in the filing of a Neqative Declar◄:ltion
by the Director of the Development Department; and
WHEREAS, no new districts are propc:►sed to be formed
by this reorganization; and
WHEREAS, the Fresno County Assesso.t· • s roll will be
used for the purpose of levying any asse:ssments or taxes on
the subject territory; and
WHEREAS;r the subject territory prop,osed to be annexed
to the City of Fresno will be exempted from taxa tir;)n for
payment of principal or interest, or any other amou.nts which
shall become due on account of any outstanding bonded indebt-
edness incurred by the City prior to the effective date of
such annexationr and upon completion of this reorganization
proposal, the subject territory will be included in Municipal
Bond Area "D" and will not be taxed for any existing bonded
indebtedness or contractual obligations;· and
WHEREAS , the reasons for this propo;$al are stated a.s
follows;
1.. Annexation of the subject terr:ltory to the
City of Fresno will result in impr0tved land
use planning. All private dev~~lopme:nt con-"
trols of the City will apply, following re-
organization.
2.. The subject territory is withit.t the City of
F.resno' s Sphere of Infl·p,ence.
3. The proposal is being initiated at the request
of several property owners within the pr1oject
area.
4. It is advantageous for the subj:ect territory to
be a part 0£. the City.

NOW, THEREFORE, BE IT Rl:SSOLVED that the Council of the
City of Fresno hereby requests that proce1$dings be ta.k,ein by
the Fresno Local Agency Formation Conu:nisston for the herein
proposed Belmont-Third No. 1 District Reo:tganization,
including the detachment of the subject territory,. consist-
ing of 85. 78 acres from the Mid Valley E'i:te Protection
District and the Kings River Conservation District, and
annexation of the same territory to the c;lty of Fresno; and
BE IT FURTHER RESOLVED that the Council of the City
of Fresno finds Environmental Assessn1ent li:Io.. 317 4 is the con--
trolling environmental document for this .ia.nnexation pro-
posal, such environmental asse~ssment has J:,een completet3.
in compliance with the California Environmental Quality
i
Act and the State Guidelines, and the CC>uncil has :ceviewed
and considered the information contained in such environ-
mental assessment prior to the approval oj: the j_ni tiation
of this annexation proposal and finds thel:"e is no poss-
ibility such proposal may have a signi.ficqtnt effect on
the environment.
