THE TULARE-~SUNNYSIDE NO. 2 DJ:~ITRICT
REORGANIZATION ORDERING A RE0J:~GANIZA-
TION OF THE CITY OF FRESNO, -THE MID
VALLEY :E'IRE PROTECTION DIS~l"RIC!T AND
THE KINGS RIVER CONSERVATION DISTRICT,,
't\1HEREAS, the Council of the City of Fresno,. pursuant
to its Resolution of Application No. 82-•'60 adopted on
February 9, 1982, requested the Fresno L:ocal Ag~tncy For-
mation Commission to take appropriate pr1oceeding·s for the
annexation of the subject territory to the City of Fresno;
and
WHEREAS, the propo~;ed reorganizatiotl. known as Tulare-
Sunnyside No. 2 District Reorganization ils described in
Exhibit "A" and graphically depicted in E:xhibit uBu; and
Ed Bielicki
WHEREAS, with notice given acco:rdin~r to law, LAFC0 met
on June 23, 1982 to hear interes.b:~d persons and consider
the proposed reorganization; and adopted Resolution No. RO-82-10
11 Making Determination and Approving Propc,sed TuJ.are-Sunnyside
No. 2, District Reorganization° of the City of Fresno, the
Mid Valley Fire Protection District arid the King!S River
Conservation District; and
WHEREAS, LAFCO Resolution No.. RO-82-·10 authorized the
Council to conduct the proceedings for the reorganization in
the manner provided by law; and
WHEREAS,,. on Au.gust 17, 1982 the Couw~il initiat~ad
proceedings for the proposed reorganizati<:>n by adopting Re-
solution No. 82-364r 0 Resolution initiati1ig proceedings for
the reorganization of the City of Fresno, the Mid Valley
Fire Protection District and the Kings River :Conservation Dis-
1 trict", and set a hearing on the proposed reorgan.ization for
September 21, 1982 at 3:00 p.m .. , in the Council Chambers; and
WHEREAS" the Council gave the required not;tc,e of the time
and place for hearing objections to the proposed reorganiza-
tion; and

WHEREAS, the Counci 1 conducted a hE!aring, at which
all persons who wished to object to the proposed reorgan-
ization were heard; and
WHEREAS, written protests or objections to the pro-
posed reorganization, delivered to the Clerk of the City
of Fresno before the hour set for hearin~J, were considered
and are on file in the office of the CleJ.:k o,f the: City of
Fresno, Count.y· of Fresno, State of Califc).rnia; and
WHEREAS, at said hearing and prior t:o cons:ideration
of protests, LAFCO 1 s resolution making determination and
approval was presenbed to the Council and summarized; and
WHEREAS, the Council considered all facto:rs. required
by law for a reorganization; and
WHEREAS 11 the Council detel:-mined that the ter:t·i tory
to be reorganized is uninhabited and that writtf:in protests
filed and not withdrawn represented less than f:iLft:l per-
cent (50%) of the assessed value of land therein; and
WHEREAS, the Fresno County Assessor's roll will be
used for the purpose of levying any cwsess:ments or taxes
on the subje<.:::t territory; and
WHEREAS, the territory proposed to be annexed to the
City of Fresno will be exE~mpt from taxation £01~ the payment
of principal or interest, or any either amounts which shall
become due on account of any outstanding b;:,nded indebtedness
incurred by the City prior to the effectiv,a date of such
annexation, and upon completion of this reorgani:zation pro-
posal, the subject territory will be included in Municipal
Bond ~.rea un" and will not be taxed for any existing bonded
indebtedness or contractual obligations; and
WHEREAS, pursuant to Fresno Municipal Code Section. 2--
2081 the subject territory is allocated to Council Dietricii:
No .. 5.,
NOW, THgREFORE, BE IT RESOLVED by the Council of the
City of Fresno as follows~
1. The Council hereby ora.ers that th1e te:rr:itory
referred to as Tulare-Sunnyside Nf>. 2 District

Re<:>rganization and des,cribed in Exhibits "A" and "B",
attached hereto, be annexed to the City of Fresno,
and the scm1e territory be detac;:hed from the Kin9s
River Cons1ervation District ancl the Mid Valley
Fire Protectio!1L District of Freisno County ..
2. This reorganization is in the test interest of
the territory of Tulare-Sunnyside No .. 2 Dist.riot Reorgan-
ization, and lands hav1e nt:>t J:>een :improperly omitted
from or included within. this reorganization ..
3. The reasons for this reorganization are:
a.. The subject territory is wtthin the City of
Fresno's Sphere of Influen,,e ~
b. Property owners within the·project area
petitioned for annexation t~o the City ..
c.. It is advantageous for the territory within
the Tulare-Sunnyside No. 2 District Reorgan-
ization to be a pa.rt of th,~ City of Fresno.
4,. The condition imposed by LAFCO, na.mely that an applicati.01n,
for reorganization to annex to the City of Fresno for the
substantially surrounded area generally bounded by Belma,nt
Avenue, Kings Canyon :Road, ,and Fanche.r Drive shall be s11h-
mitted to LAFCO prior to completion .of the subject proposal,
will be met prior to rec6rdation of the project ..
IT IS FURTHER RESOLVED by the Council .of the City of
Fresno that the Tulare--Sunnyside No. 2 District Reorganization
be and is he:r:eby allocated to Council .Distrlct No. 5 ..
