WHEREAS, proceeding.s for a propoised reorganization we:rei
commenced by the City of Fresno pursu.rn.nt to its Resolution

No .. 82-151, adopted on April 6, 1982; and
WHEREAS, the Fresno Local Agency Formation Commission,,
on 23rd day of iJm1.1~ 1982, met at the noticeid time and
place to consid1er all matters relievant: to the proposed reor-
ganization and heard all pel'.:-sons i:ntel~estied therein 1 and
adopted at the time and in the form and manner .prescribed by
law its Resolution No. R0-82-32 "Making Determination and'
Approving the proposed Michigan-Sixth No. 3-A District Reorgan-
izationu, a copy of which is attached hereto and identified
as Exhibit uA1
'; and
WHEREAS, at. said June 23, 1982 LJ;I.FCO hearing, the Commission•s.
approval included a revision of the original project boundaries to
include the unincorporated area north of Clinton Avenue; and
WY-:IEREAS, the Fresno County Assessior "s Roll will be
used for the purpose of levying any as,sessments or taxes
on the subj·ect property; and
WHEREAS, the subject territory px·oposed to be annexed
to the City of Fresno shall be exempt from taxation for the
payment of p.r:incipal or interest, or any other amounts which
become due on account of any outstanding bonded indebtedness
incurred by the City prior to the effective date of s:uch
annexation, and upon completion of the. reorganization pro-
ceedings for this proposal the subject territory will be included
in Municipal Bond Area "D '' and will not be taxed for any existing
bonded indebtedness or contractual obligation ..
NOW I THEREFORE, BE I'l1 RESOLVED, · D:E!TERMINED ANP ORDERED
by the Council of the City of Fresno a:s follows:

1.. Proceedings are hereby initiated .for the proposed
Michig·an-Sixth No. 3--·A Dist:i~ict Reorganiza~ion as
described in E.}thibit "B" and gra:phically depicted
in Exhibit "C" wherein the City of Fresno, the
Mid Valley Fire Protection District, and the
Kings River Conservaton Dist.riot are each subject to
a change of or,gani:zation.
2. All of the. territory affected is within the County
of Fresno ..
3. For the purpose of the proposed re1:>rganization.,
the subject territory is found to be inhabited ..
4. The reasons for this prop<:>s;ed reorgani zatio.n are as
follows;
a.. The subject territorj7 is within tbe City of
Fresno's Sphere of I11.f;luence ..
b. Property owners within the project: area
:f?eti tioned for annexation to the City ..
c., It is advantageous foJ: the territory within
the Michigan-Sixth No. 3-A District Reo.:r:gan ... ,
ization to be a part of the Cit~{ of Fresno.
5. The condition imposed by LA.FCC), nan1ely that the City of
Fresno hold a neighb<::)rhood -information he.aring for
the residents of the revised proposal area, has been
complied by the City.
6. October 26, 1982, at the hour of 3:00 p.m., in the
Council Chamber, City Hall,,. 2326 Fresno Street,
Fresno, California, which date is not less than
fifteen days nor more than sixty days after the
date of adoption of this res<:,lution/, be, and is

of hearing on the proposed. reorganization .. At t.his

protest said reorganization ,shall do so .bY written
communication filed with the Clerk of the City of
Fresno not late~r than the hour set for hea:cing.
Written protests shall be si9ned and submitted
after the adoption of this r~~sc,lution and shall
contain the date of signatur~~. A written protest
by a landowner shall contain·a description suf-
ficient to identify the land owned by him. A
written protest by a resident.-vote1~ shall cc:>ntain

the residential address of s·l.1ch voter.
7. The Clerk of the City of Fref~no shall give notice
of such hearing once in a ne1yrspaper of general
circulation at least fifteenldays prior to the
date specified herein for heiiring.
8.. The Clerk shall further causE,~ a copy of this re-
solution to be posted on or near the door of the
meeting place of the council ir said posti:ng to be
commenced at least fifteen d,~ys prior to the date
specified herein for hearing-and continue to the
time of said hearing.

to each person who owns land within the sul,ject
territory and to all other a;Efeioted ci tief; or dis-
tricts, and any other person wh<t> has a written re--
quest for special notice. S11ch mailing shall be by
first class mail, postage prt~paid, at least 15 days)
prior to the day specified h~~rein for hearing.

WHEREAS, the Commission has reviewed aind considered the
information in the Negative Declaration as provided in the Executi v ,
Officer's Report duly prepared and fil,ed by the C.i.ty of Fresnc,.
The Commission has also reviewed cLnd. qonsidered the changes in the
project made by the inclusion of pl:-operty and the inclus;i.or~ does
not substantially alter the proj.ect whl1ch was considered in thEt
Negative Declaration.
