HomeMy WebLinkAboutResolution - City Council - 82-431 - 1982-09-21.,. • RESOLUTION NO. 82-431 RESOLU'rION INITIATING l?ROCEEDJ.NGS FOR THE REORGANIZATION OF THE CITY OF'FRESNO, THE KINGS RIVER CONS.ERVATION DISTJalCT AND ~HE MID VA!.tLEY FIRE PROTECTION DitS!1RICT, IN- VOLVING UNINHABITED TE'.RR.ITOR'Y DESCRIBED HEREIN AND DESIGNATED AS THE l~ROPOSED LEWIS-·ROWELL NO. 4 DISTRICT R]~ORGANIZA- TION, SETTING THE TIME, DATE AND PLACE FOR HEARING PROTESTS THERETO, AND.GIVING NOTICE THEREOF Ed Bie)icki WHEREAS, proceedings for a prc>posed reorganization were commenced by the City of Fresno pursuant to its Resolution No .. 82-203, adopted. on May 11, 1982; and WHEREAS, the Fresno Local Ag.ency Fo:rmati.on Commission on the 4th day of August, 1982, met at the 1ttoticed time and plac1~ to consider all matters relevant to the proposed reorganizatiQ1n and heard all persons interested the:t:'ein, and adopted at the time and in the form and manner prescribed by· law its Resolu- tion No. RO-82-38, 0 Mak:ing Determination and Approving the Proposed Lewis-Row·ell No .. 4 District Reor,9'anization°, a copy of which is attached hereto and identified. as Exhibit "An; and. WHEREAS, the Fresno County Assessor 1 ~~ roll will be used j:or the purpose· of levying any assessments or t.a1{es on the subj eci: property; and WHEREAS, the subject territory proposed to lbe annexed to the City of Fresno shall be exempt:. from taxati,on for the pa:t7ment of principal or interest, or any other amounts which shall become due on account of any outstanding bonded indebtedness incurred by the City prior to the effective date of su;ch annexation; upon completion o,f the re\organization proceedings for this prcpos,al the subject territorji will be included in Municipal Bond Area 11 D'1 and will not be ta..xed for any existing bonded indebtedness or contractual obligation .. NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED by the Coun.cil of the City of 1'.,resno, as follows: 1.. Proceedings are hereby initiated tor the proposed Lewis Rowell No.. 4 District Reorgraini2:ation as described in Exhibit "B II and grap:ti.ica:lly de- picted in Exhibit "C" wherein the City of Fresno, Page l of 4 I► the Mid Valley Fire Protection District and the Kings River Conservation Dif~trict are all subject to a change of organizat:ion .. 2. All of the subject territory affected is within the County of Fresno. 3. Fox the purpose of the proposed reorganization, the subject territory is found to be uninhabited. 4. The reasons for this proposed ,i-e1::,r9anizatio1-i are f , "L as o.L. ows: a. The subject territory is within the City ofc Fresno ' s Sphere of Inf 1 u,e~nce • b. The proposal has been initi,aLted by the City of Fresno in accordance witr1 the Council• s policy to unify the metropol:itan area. The proposal also includes nine sta.te owned parcels. c. It is advantageous for the territory within the Lewis-Rowell No. 4 Dist:cict Reorganization. to be a part <>f the City of Fresno,. 5. The conditions imposed by LAFCO, stipulates that: nPrior to completion the City of Fresno shall sub- mit an annexation proposal for the island area to the south between Cedar and Maple Avenues". The island to the South between Cedar and Maple Avenues has been design;1;ted as Harvey-Maple No,. 3. The annexation proposal Harvey-Maple No,, 3 has been. started and the condition will be met prior to the completion of Lewis-Rowell No.. 4 District Reorga11.iza tion. 6. Octobex 26, 1982, at the hour of 3: 00 p .. m..,, in the Council Chamber,, Cit:y-Hall, 2326 F:r·esno Street, :F'resno, California, which date .i.El, not less than fifteen da~rs nor more than sixty · days after the date of adoption of this resolution is hereby, es- tablished as the time, date and place of hearing on Page 2 of 4 + • • the proposed reorganization. ll,t this time and place any interested person desiring to protest said re- organization shall do so by written communication filed with the Clerk of the City of Fresno not lateJ~ than the hour set for hearing. Written protests shatll be signed and submitted after the adoption of this resolution and shall contain th1~ da.te of signature. A written protest by a landowne;ir shall contain a description sufficient to ident.lfy the land owned by him. 7. The Clerk: of the City of Fresno shall give notice of such hearing once in a newspaper of general circulation at least fifteen days prior to the date specified herein for hearing. 8. The Clerk shall further cause a copy of this l resolution to be posted on or n~~ar the door of the rne1eting place of the CounciJ., said posting to be commenced at least fifteer.t days pl:ii::>r to the date specified herein for hE11aring and. continue to the time of said hearing. 9 . The Clerk shall furthex cause ncdt:ice to be mailed to each person who owns land wit.bin the subject territory and to all other affected cities or dis- tricts, and any other person who has a written re- quest for special :notice" Such n,tailings shall be by first class mail, postage prepaid, at least fifteen days prior to the day specified herein for hearing,. 10.
