WHEREAS, proceedings for a proposect reorganization were
commenced by the City of Fresno pursuant to its Resolution
No .. 82-64, adopted on January 9, 1982; and
TrIBEREAS"' the Fresno Local Agency Fo:i=mation Commission,
on the 4th day of ll~ugust 1982, met at thii~ noticed time and
plac,e to consider all matters relevant to the proposed reor-
ganization and heard all persons interested therein,. and
adopted at the tim(a and in the form and ma1iner prescribed by
law its Resolution No. R0·-82-35 11 Making Determination and
Approving the proposed Fountain-Brawley Ni::>. l District Reorgan-
ization", a copy of which is attached her~~to and identified
as Exhibit 11 A"; and
i"1HEREAS, the Fresno County Assessor• ::i Roll will be
used for the purpose of levying any assess1ments or ta:x:es
on the subject prope1rty; and
WHERE.AS, the s1,1bj ect terri t.ory proposed to be annexed
to the City of Fresno shall be exempt· from taxation for the

payment of principal or interest, or any other amounts which
become due on account of any outstanding bonded indebtedness
incurred b:t the City prior to thei effective date c1f such
annexation, and upon completion of t.he reorganization. pro ....

in Municipal Bond Area 11 D 1' and will not be taxed for any existing

1. Proceedings are hereby initiated for the proposedt
Fountain-Brawley No. 1 Distri~::t Reorganizatlon as
described in Exhibit "B" and 'fJraphically depicted
in Exhilbi t "C" whe1~ein the Ci t.y of Fresno, the
North Central Fire Protection District, and the
Kings River Conservaton Distr:Lc~t ,,-re ea.ch subject to
a change of organization.
2. All of the territory affected is within the County
of Fresno ..
3. For the purpose of the propos~~d reorganization,
the subject tE~rritory is found to be inhabited.
4. The reaLsons for this proposed reorgani:zatic:>n are as
follows;
a. 'J.1he subject territory is 'l-rithin the City of
F:resno ' s Sphere of lnfl uet1ce,.
b.. The proposal was initiated. by the City of
Fresno in keeping with t.h~~ policy to unify
the metropolitan are:a.
c. It is advantageous for thei te1:ritcry within
the Fountain-Brawley No. 1 District Reorgan-
ization to be a. part of the City of Fresno.
5. 1.I'h'9 condition imposed by LAFCO will be complied wit.hr
as follows:: (1} landowners will not be forced to
connect to City sewer lines unlt.~ss. they ha~'e first
been o:E fered the opportunity to create an improve·-
ment district for that purpose ..

time and place any interested :person de.:siring to
protest said reorgani2:ation sh~a.11 do so by writtei1
communi.ca tion filed with the Clerk of thei City of
:Presno not later than the hour set for hearing.
Wri tte11 protests shall be signed and submi tt.ed
after t:he adoption o:E this res:olution and shall
contain the date of signature. A written protest
by a landowner shall contain a description suf-
ficient to identify the land o'W'l:ied by him .. A
written protest by a resid€1nt-v<:,te:r shall contain
the residential address of such voter ...
7.. The Cle:c-k of the City of Fresno shall give notice
of such hearlng once in a newsp(;tper of general
circulation at least fiftf-=!1an days prior to the
date specified herein for heari:n.◄;r ..
8.. The Clerk shall further cause a. copy of this re-
solution to be posted on or near the doo:r: of the
meeting place of the Council, sa.id posting to be
commenced at least fifteen days :prior to the date
specified herein for hearing and continue to the
time of :said hearing.
9. The Clerk. shall further cause noi~ice to be mailed
to each person who owns land within the subject
territory and to all other affected cities or dis-
tricts, and any other person who has a written re--
quest £or special notice. Such 1mailing shall be by
first cla.ss mail, postage prepaid.,. at least 15 days
prior to the day specified herein. for hearing .•
10 .. The Clerk is hereby instructed to, forward a copy of
this resi:>lution to the executive iofficer of the Fresno
Lcical Agency Formation Commission.
