1. Proceedings are hereby initiated for the proposed Alluvial-Mora:ga No. 1 IDistrict Reorganization as described in Exhibit "B" and graphically depicted in Exhibit "C" wherein the City of Fresno the Mid Valley Fire Protection District, and the Kings 'River Conservaton District are each subject to a change of organization:. 2. All of the territory affected is within the County of Fresno. 3. Fox' the purpose of the proposed reorganization, the subject territory is found to be inhabited. 4. The reasons for this proposed reorganization are as follows: a.The subject territory 1s, within the City of Fresno r s- Sphere of ` influence . b. The Cite of Fresno has initiated 'thi-s proposa.l pursuant to the Councils policy to unify the metropolitan area. C. It is advantageous' for the territory within` the Alluvial.--Maraga34. l District Reorgan- ization to be a past of the City of Fresno.' 5. The terms and conditions imposed by LAFCO, are as follows., (1) landowners will not be forced to connect to City sewer lines unless they have first been offered the opportunity to create an improve- ment district for that purpose, (2) the City will conduct a surrey of landowners before installing street lighting, to ascertain property owners' desires with respect thereto, and; (3) the City will agree to assume the duties of Bluffs' Community service District, upon dissolution of the District, as pertaining to the maintenance on, median lot APN 405--1.70-63T. Avenue to the City 7 of Fresno and detach from the Mid --Valley Fire -Protection District and Kings River Conservation District in the County of Fresno, and WHEREAS an appii cation for saa.d prof sal was accepted for 10 filing by the Executive Officer of this Local Agency formation 11 Comma. s s i on ; and 12 WHEREAS, s aid - appli, ea.ti on was set f67 hearing' by the Executive 13 Officer on the 4th day ' of August, 19821 at the hour .of 1. 30 p . m." of 14 said days and 15 WHEREAS, notice of the hearing of said application was duly 16 given by mail, posting, and newspaper publication as required by 17 law; and 18 WHEREAS, the Executive officer reviewed said application .and 19 prepared a report, including his recommendations thereon, said 20 application and report having been presented to. and considered by- 21 this Commission; and 22 WEEREAS'f this Commission considered a,lI relevant factors and 23 heard all interested parties wishing to 'speak on said application; 24 and 25 WHEREAS, the Commission has reviewed and considered the 26 information.in the -Negative Declaration as provided in the. Executive 27 Officer's Report duly prepared. and filed by the City of Fresno. 28 NOW, THEREFORE, BE IT RESOLVED that the Local Agency Formation 29 Commission of the County of Fresno does ``HEREBY RESOLVE, DETERMINE, 30 AND ORDER as follows: 31 Section 1. Prior to completion of this proposa.l., the city shall agree 5 that before any landowner in the area shall be required to extend. 6 and/or connect sewer lines, the City shall offer to begin pre- 7 ceedings to form an improvement 'district, for such extensions and 8 improvements Such agreement shall be made available tp each landowner. 2. The city shall survey residents to determine their desire 1 for street l ghting;prior to the installation of street lighting- 12 3. The City of Fresno Shall agree to assume the responM 13 5 * bilities of the Bluffs community Services District aster District 14 dissolution, which at a minimum shall be considered as the pro- 15 vision of landscaping and maintenance on the W. Moraga Avenue' urethan lot f APN 4Q5--170-63T? .` The City shall. confer with the 17 District Board as to the type of landscaping and improvements desired.
