Reorganization and described. in Exhibits "A" and "B",
attached hereto, be annexed to the City of Fresno,
and the same territory be detached from the Kings
River Conservation District and the: Mid Vallev
Fine Protection Districtof Fresno County,

This reorganization is in the best interest of
the territory ;of White -Garden No. 4 District Reorgan-
izationt and lands have not been improperly omitted.
from or included within this reorganization.

The reasons for this -reorganization are:
a. The subject territory is within the City of
Fresno Sphere of Influence.
b. The project has been initiated in accordance
with the Council policy to unify the metro-
politan area, and includes parcels that are
subject to a contract wherein the owners I
agreed to consent to annexation to the City of
Fresno in exchange for the Citys agreement to
extend municipal water services to the properties.
C. It is advantageous for the territory within
the White -Garden No. 4 District Reorgan-
ization to be a : part of the City of �`resn.o.
4.
The conditions imposed by LAFCOf namely that the
City of Fresno shall gubmit ,an annexation proposal
for the island created to the west of 'the subject
proposal will be complied. with. City staff has —
begun preliminary proceedings for the annexation
of said unincorporated island area and is designated
White -Chestnut No, 4.District Reorganization.

IS FURTHER RESOLVED by ` the Council of the City of
Fresno
that the White -Garden No. 4 District Reorganization

is hereby allocated to Council District No. 5.

WHEREAS, preliminary proceedings were .initiated by the City
of Fresno to annex territory generally located northeast of

Belmont and Chestnut Avenues to the City of Fresno and detach, from
7
the Mid -Valley Fire Protection District and ;Kings River Conser-
8
vation District in the County 'o,f ;Fresno, and
9
WHEREAS, an application for said proposal was accepted for
10
filing by the Executive Officer of this Local Agency Formation
11
commission; and

WHEREAS, said application was. sat for hearing, ' by the Executive
13
officer ` on the loth day of May, 1982, at the hour, of l": 30 p,,mr of
14
said day; and

y+iREAS, notice of the hearing of said application, was duly;
16
given by mail, posting", and newspaper publication as required by
17
laws and
18
WHEREAS,, the Executive Officer, reviewed said application and
19
prepared a report, including his recommendati.ons thereon,. ' said
20
application and report having been presented to, and considered by
21
this Com-niasion ; and

WHEREAS, this Commission considered. all .relevant factors and.
23
heard a3.1 interested parties wishing to' spea.I on said application,-

and

WHEREAS, the Commission :has reviewers and considered the
26
information in the Negative Declaration as provided in the Executive
27
officer's Report duly prepared .and filed. by' the City of Fresno.

NOW, THEREFORE, BE IT RESOLVED that the Local Agency Formation

Commission of the County of Fresno does HERESY RESOLVE, DETERMINE,

Section 1 Said proposal is approved 'subject to the term

conducting agency ordering this reorganization shall provide that

for the island created to the west of the subject proposal:

Section 2. Said territory is found to `be uninhabited' and
is assigned the' following distinctive short form designation:

agency, and the governing body of said agency. is hereby directed

to initiate reorganization proceedings in compliance with this

.resolution.
