HomeMy WebLinkAboutResolution - City Council - 82-425 - 1982-09-14WHEREAS,,, -the Council conducted a hearing, at which all persons Who wished to object to the proposed reorgan- ization were heard; and WHEREAS, the Council continued said 'protest hearing to September 141 19821 at 3:00 p,m.., in the Council Chamber, because notices regarding the scheduled protest hearing were mailed prior to the required 1;5 day noticing time requirement; and t WHEREAS, said date for continuance would allow for more time than the 15 day noticing time requirement; and; WHEREAS, written. protests or `objections to the pro- posed reorganization, delivered to the Clerk of the City ¢: e f r'hearin of Fresno before the hour set 4 g, were considered and are on file in the office of the C"lerk of the City - of Fresno, County of Fresno, State of California; and � WHEREAS., at said hearing and prior to consideration of protests, LAFCO's resolution making determination and approval was p resented to the Council ` and summarized • and WHEREAS, the Council considered all factors required by law for a reorganization t and fi WHEREAS, the Council determined that the - territory to be reor anized is uninhabited and that written protests g` filed and not withdrawn represented less than fiftlr per- cent (50o) of the assessed value of land therein, and WHEREA5, the Fresno County Assessor's roll will be used for the purpose of levying any assessments 'or taffies on the subject territory; and WHEREAS, the territory proposed to be annexed to the City of Fresno Fill be exempt from taxation for the payment of principal or interest, car .any :other amounts which shall become due can account of any outstanding bonded`indebtedness incurred by the City prior to the effective date of such annexation, and upon completion of this reorganizat-ibn Page'2 of proposal., the subject territory will be included in Municipal Bond Area "D"'and will not be taxed for'any'existing bonded indebtedness or contractual ob1' ations; and WHEREAS, pursuant to Fresno Municipal Code Section 2- 208, the subject territory is allocated to Council. District No. 5 NOW, THEREFORE, ` BE SIT RESOLVER by the Council of the City of Fresno as follows 1. The Councilhereby orders that the territory referred to as: Florence -maple No. 1 District Reorganization and. described :in 'Exhbita5 "" and "B" attached hereto,, be annexed to the City -of Fresno, and the same territory be detached romf"the Kings; River Conservation District and the Mid valley Fire Protection District of Fresno County. 2. This reorganization is in the best interest of the territory of Florence --Maple No. l District Reorgan- ization, and lands have not been irmroperly-omitted from or included within this reorganization. 3. The reasons for this reorganization are.: a. The subject territory is within the City of Fresno's 'Sphere of Influence. b. The annexation was initiated as a result of a request from one of the property owners within the project area. c . It is ` advantageous for the territory, within the `loxence--Maple Igo. MAKING DETERMINATION AND APPROVING) RESOLUTION OF THE PROPOSED "FLORENCE-MAPLE 41" » RESNC LOCAL AfiEwG`Y 2 REORGANIZATION "FORMATION COMMISSION 3 4 WHEREAS, preliminary proceedings were initiated by the City 5 of Fresno .to . annex territory generally located on both sides of 6 Maple Avenue and north of Florence Avenue to the City of Fresno, 7 and detach from the Mid -Valley Fire. Protection District and Kings 8 River Conservation District in the County of Fresno; -and L 4 k WHEREAS_, an application for said'proposal was accepted,for 10 filing by the Executive Officer of this Local.Agency Formation 11 Commission:; and f ! 12 WHEREAS, said application was set for hearing by the Executive 13 Officer on the 26th day of May, 1982, at the hour of 2. 45 p.m. of 14 said day; and 15 WHEREAS, notice of the hearing of said application was duly 15 given by Mail, posting, and newspaper publication as 'required by 1T law, and 18 WHEREAS, the Executive Officer reviewed said application and 1g prepared a report, including his recommendations thereon, said. 20 application and report having been presented to and considered by 21 this Commission; and 22 WHEREAS, this Commission considered all relevant factors and 23 heard all interested parties'Torishinr to speak on said application,- .24 and 25 WHEREAS, the Commission has reviewed and considered the 26 information in the Negative 'Declaration as provided in the Executive 27 Officer's Report duly prepared and filed by, the City of Fresno. 28 NOW, THEREFORE, BE IT RESOLVED that the Local Agency Formation 29 Commission of -the -County of Fresno does HE ;EBY RESOLUTE, EETFRMINE t 30 AND ORDER as follows: COUNTY orr FRIESNO FIRESNO.
