WHEREAS, preliminary proCeedlings were ni�tiat d by the city

of Fresno to annex territory located generally -south of Belmont
Avenue and east of Chestnut Avenue to the city of Fresno and detac
7
from the Mid -Palley Fire Protection District and Ungs River
$
Conservation District in the County of Fresno; and
WHEREAS, an application for said proposai was accepted. for
10
filing by the Executive Officer of this Local Agency Formation
Commission, and
12
WHEREAS,,said application was Set for hearing ,by the Executive
13
Ufficer on the 2bth day of May, 1982, at the hour of 1:30 ,p.mo of
14
said day,and.

WHEREAS noticeL of the hearing of said' application was duly `' a

given by mail, ,posting and newspaper publie"ation as required by

law ; and

WHEREAS, the Executive Officer reviewed LSaid application and

prepared a report including his recommendation thereon, said
20
application and ,report having been presented to and considered by

this Commiss i on and
'WHEREAS', this Commission considered all re .evant factors and

heard all interested parties wishing to speak on said applicat on

WHEREAS, the Commissioln has reviewed and considered the

information in the Negative Declaration as provided in. the Executive
27
Offi.cer' a Report duly prepared and filed by the Gi.ty of Fresno

Nowe THEREFORE', BE IT RESOLVED that the Local Agency :Formation

Commission of the County of Fresno does HEREBY RESOLVE, DETERMINE

Section 1.;. Said proposal is approved subject to the terms

and conditions hereinafter specified, .Any resolution of the

conducting agency ordering this reorganiz ation shalx provide that

such reorganization shall be subject to ' the followih- g terms and

conditions
1 ` Prior to completion, the City shall submit an annexation','

proposal for the island area to the west between Garden and
6
Chestnut Avenues.

Section 2. Said territory is found to be uninhabited and
8
is assigned the following distinctive sheet form designati on
"Grant -Garden #111.

-Section 3. The City of Fresno ir, 'Yi esig*n, aced as the conducting

agency, and the governing body of said agency is hereby di,�ected :..'

to -initiate reorganization proceedings in compliance with this

resolution.

Section 4. Further proceedings . shah, be initiated by the

conducting agency not later than 35 days after the date of ladoPtion

of the Commission resolution and shall be cond.ucte anal co' mp eted

pursuant to required law. Proceedings and any resolut on.: of
