RESOLUTION NO, 82-383
A RESOLUTION OF THE COUNCIL OF THE CI `Y OF F tESNO
CONDITIONALLY APPROVING. TENTATIVE TRACT NO. 3518
(DAYTON VILLAGE CONDOMINIUM CONVERSION)
WHEREAS., a Tentative Map of Tract No. 351 (Dayton, Village
Condominium Conversion)was filed with the City of Fresno and
proposes the conversion of '56 apartment units to ` 56 condominium
units and one common lot on 2.11 acre(s) of land located on the
south sine of East Dayton ,Avenue between North Chance and North
Cedar Avenuel and
WHEREAS, the Planning Commission conducted e public hearing to
review the proposed subdivision and considered the staff report and
ev*dence and testimony with respect to the proposed ;subdivision, and
concluded that the tentative tract map is consistent with the
adopted General Plan and is in conforzance with the purposes of the
Condominium Conversion ordinance of the City of Fresno, arid'
recommended its conditional approval; and
WHEREAS, on August 17.- 1982, the Council of the -City of Fresno
considered the proposed subdivision and received the report and
recommendations of the Planning Commission and of its staff.
NOW, THEREFOR%, BE IT RESOLVED that the Council of the City of
Fresno finds that approval of the tentative tract map is consistent
with the adopted General Plan, any applicable,specific plan, and the
findings required pursuant to Section- 66410 et. seq. of the;
Government Code, and is in 'conformance with the purposes of the
Condominium Conversion ordinance of the City of Fresno
BE IT FURTHER RESOLVED that the Council of the City . of Fresno
hereby approves the Tentative Map of Tract No. 351.8 (Dayton Village
Condominium Conversion) subject to compliance with the,conditions of
the following:
1. Development -Department Conditions of Project Approval dated
July 21, 1982, except for the following recommended waivers:
a. Recommend waiver of the installation ' of two (2 ) of -the,
required three (3) additional washers and two(2) of the
required five (5)additional dryers. (Condition Nth. 9
of the Conditions)
b. Recommend waiver of the requirement for the installation
of an underground -serviced .street lighting system.

2. Compliance with the requirements of the Inspection Division
memorandum dated May 11, 1982
3. Notwithstanding any provisions contained in the. s-u m.itted
` Tenant. Relocation and Assistance Plan required by Section
12-904--f of `the Fresno Municipal Code, the Plan shall also
include a minimum moving expense payment` of Two Hundred
Dollars ($200,0 ) for each tenant in residence as of June 1,
1982, and forced to vacate a unit due to the conversion
after receipt of the 180-d notice of conversion prior to

termination of "tenancy,
4 If after three years the final map for the proposed
conversion has not been approved, the tentative map approval
shall expire:unless it is demonstrated that substantial
progress has been made towards completion of the conversion
project, as evidenced by physical improvement of the units
and the project site, the offering for sale of condominium
units in the project, and acceptance by buyers of a
reasonable number of such units.
