Valley Fire Protection District, the Rings River Conservation District and the Pinedal.e County Water District are each subject to:a change of organization. 2. All of the territory affected is %Ithan the County of Fresno 3. For the purpose of the proposed reorganization t they subject territory is found to be inhabited. 4. The reasons for this- proposed reorganization are as follows a. The subject territory is within the city of Fresno"s Sphere of influence. b. Previous owners Of the subject territory signed a Statement of Covenants consent-� - zng to annexation to the City cif Fresno and which "run with the subject property i and shall be binding upon each successive owner of; the subject territory." c. It is advantageous for the territory within Si.er,ra--Maros. No. 2 District Reorganization to bo a part of the City of Fresno. 5. The condition imposed by LAFCOr namely that annexa- tion to the Pined.ale` County Water District be made a part of this proposal, has been. met, 5. September 21, 1982 at the hour 3:00 p.m., in the Council Chamber, City Hail, 2326 Fresno Street, Fresno, California, which date is not :Less than fifteen days nor more than sixty days after the date of adoption of this resolution, bet and is hereby, established as the tame, date and place of hearing on the proposed reorganization At this time and,place any interested person desiring to protest said reorganization shall do so by written { f Page 2 of 3 I ESOLU'I'ION NO RO- 82-- 24 . l MAKING DETERMINATION AND 'APPROVING) RESOLUTION OF THE - PROPOSED "SIERRA-MAROA #2i4 FRESNO LOCAL AGENCY 2 REORGANIZATION FORMATION COMMISSION jC 1 4 WHEREAS, preliminary proceedings were 'initiated by the City -`5 of Fresno to annex territory ` generally Located ' at the southeast 6 corner of Sierra and Maroa Avenues to the City of 'Fresno and detach 7 from the Mid --Valley Fire 'Protectioln District and Kings River 8 Conservation District in the County' of Fresno; and, 9 WHEREAS, an application for said proposal was accepted for 10 filing by the Executive Officer of this Local Agency Formation 11 Commission, and 12 WHEREAS, said application was set for hearing by the Executive 13 Officer on the> 25th day of May, 1982, at the hour of l: 30 p.m- of 14 said day; and 15 WHEREAS, notice of the hearing of said application was dull 16 given by mail, pasting{ and newspaper publication as� required by 7 1 aw, and. 3.$ WHEREAS, the Executive Officer reviewed said application and 19 prepared a report, including his recommendations thereon, said 20 application and report having been pre -anted to and considered by 21 this Commission; and 22 WHEREAS, this Commission considered a1 relevant factors and 23 heard all.-nterested parties wishing to speak on said application; 24 and 5 WHEREAS, the Commission has reviewed and `considered 'the ` 26 'information in' the Negative Declaration as provided in. the Executive 27 Officer's Report duly prepared and filed by the City of Fresho. NOW, THEREFORE, BE IT RESOLVED that the Local Agency Formation` 29 Commission of the County .of Fresno does HEREBY RESOLsl'E, DETERMINE, 30 AND ORDER as follows: 31 Section 1. Said proposal is approved subject, to the terms 32 and conditions hereinafter specified. Any, resolution of the COUNTY OF FRESN0. Proceedanos and any resolution of 17 approval shall comply with the Commission resolution of approval.# 18 Section 5.
