For the purpose of the proposed reorganization.,
the subject territory is found: to be uninhabited .

The reasons for this proposed reorganization are
as follows:
a. The subject territory is within the City
of Fresno' s Sphere of Influence.
b The subject territory includes parcels of
owners who have wateragreements consenting
to annexation in exchange for the provision.
of water services from the City of Fresno.
C. It is advantageous for the territory within
the White -Garden No. 4 Distract Reorganization
to be apart of the City of Fresno,

The conditions imposed by LAFCO, namely that the City of
Fresno shall submit an annexation proposal for the .island
created to the west of the subject proposal has been com-
plied with. City staff has begun preliminary proceedings
for the annexation of saidunincorporatedisland: area and
.s designated White -Chestnut No. 4 DIstr ct Reorganization

September 14, 1982 at the _hour o 3:00 p.m., in the Council
Chamber, City Hall, 2326 Fresno Street, Fresno, California,
which date is not less than fifteen days nor more than
sixty days -after the date of adoption of this resolution
is hereby, established as the time, date and place of
hearing on the proposed reorganization. At this time and
place any interested person desiring toprotest said re-
organization shall do so by written communication filed
with the Clerk of the City of Fresno not later than the
hour set for hearing. Written: pretests shall be signed
and submitted after the adoption of this resolution
and shall contain the date of signature.

WHEREAS, preliminary proceedings were initiated by the City
5
of Fresno to annex territory generally located northeast of
6
Belmont and Chestnut Avenues to ' the : City of Fresno and detach from
7
the Mid -Valley ` Fire. Protection District and Kings River Conser-
8
gyration District in the County of Fresno; and
9
WHEREAS, an application for said proposa�l was accepted for
10
filing by the Executive Officer of this Local Agency Formation

commission; and

WHEREAS, said application etas set for hearing by the Executive
13
Officer on the 26th day of May, 1982, at the hour of 1:30 p.m. of,
14
said day; and
15
WHEREAS, notice of the hearing of said appll.cat on was 'duly
16
given by mail, posting, and newspaper publication' as required by

law ; and

WHEREAS, the Executive Officer reviewed said application. and
19
prepared a report, including, his recommendations thereon, said
20
application and report having been presented to and considered by
21
this Commission; and

WHER.EAS, this Commission considered allrelevant factors and
23
heard all interested parties wishing to spear , on said applications
24
and

WHEREAS, the Commission has revi ewe d and <considered ' the

information in the Negative Declaration as provided in the Executive
27
Officer' s Report duly prepared and filed by the City of Fresno.

NOW, THEREFORE, BE IT RESOLVED that the Local Agency Formation

Commission of the County of ;Fresno does HEREBY RESOLVE, DETERMINE,

AND ORDER as follows.

Section to Said proposal is approved subject to the terms

such reorganization shall be subject to the following terms and

conditions:

1. The City of Fresno shall submit an annexation proposal

for the island created to the west of the subject proposal.

Section 2. Said territory is found to be uninhabited and
7
is assigned the following distinctive short form designation:

"White -Garden # 4 « .'

Section 3. The City of Fresno is designated.. as the conducting
10
agency, and the governing' body of said agency is hereby directed
11
to initiate reorganization.proceedings in compliance with this
12
resolution.

Section 4.' " Further proceedings shall, be initiated by the
14
conducting agency not later than 35'days after the date of adoption.
