HomeMy WebLinkAboutResolution - City Council - 82-352 - 1982-08-03Reorganization and described in Exhibits "A" and "B" attached hereto, be annexed to the City of Fresno, and the same territory be detached from. the Kings River Conservation District and the Mid Valley Fire Protection District of Fresno County. 2. This reorganization Is in the best interest of the -territory of Belmont -Clovis No. 3 District Reorgan- ization, and lands have not been improperly omitted from or included within this reorganization. 3. The reasons for this; reorganization are: a. The subject territory s within the City of Fresno's Sphere of Influence.' b. The .owners of six of the parcels within the project area have expressed a desire to annex to the City. C. it is advantageous for the territory within the Belmont -Clovis No. 3 District Reorgan- ization to be a part of the City of Fresno. _ IT 15 FURTHER RESOLVED by the Counci of the City of Fresno that the Belmont -Clovis No. 3 District Reorganization be and is hereby allocated, to Council.Bistrict No. 5. R.O--82--11 rr 1 qt ,itrs.a,,: l MAKING DETERMINATION AND APPROVING, 3 t �s£? ,UTIONOF THE PROPOSED "BELMONT-CLOVIS #3" VRE�No LOCAL AGENCY r Lr��3. �; : �;.1 .r.<r:� ��'7RMATION COMMISSION REORGANIZATION `� -------------------- 4 WHEREAS, preliminary, proceedings were initiated by the City 5 of Fresno to annex territory generally located near Clovis and 6 Belmont Avenues to the City of Fresno and detach from the Mid- 7 valley Fire Protection District and Kings .River Conservation g District in: the County of Fresno; and 9 WHEREAS, an application for said propdsal was accepted for 10 filing by the Executive Officer of this Local Agency Formation ll Commission; and 12 WHEREAS, said application was set forbearing by the Executive', 13 officer on the 28th day of April, 1982, at the` hour of 145 p.m. la of said day; and 15 WHEREAS, , notice of the hearing of ' said application was duly 16 given by mail, posting, and newspaper publication as required by 17 law; and 18 WHEREAS, tn.e Executive officer; reviewed said application and 19 prepared a report, including his recommendations thereon, said 20 application and report having been presented to and considered by 21 this Commission;, and 22 WHEREAS, this Commission considered all relevant factors and 23 heard all interested parties wishing to speak on said application; 24 and 25 WHEREAS, the Commission has reviewed and considered the 26 information in the Negative Declaration as provided in the 27 Executive Officer's Report duly prepared and filed by the City, 28 of Fresno. 29 NOW, THEREFORE, BE IT RESOLVED- that the Local Agency Formation 30 Commission of the County ` of Fresno does.HEREBY RESOLVE, DETERMINE, . 31 `SAND ORDER as follows. - COUNTY OF FRESNO i n t A l Section I. Said proposal is approved with revised boundaries 2 to delete APN 462-183--11, and a revised map and legal description 3 shall be submitted to the Executive Officer, subject to approval b by the County Assessor. Any resolution of the conducting agency ordering this reorganization shall provide that such reorganization 6 shall not be subject to any terms and conditions. 7 Section 2. Said territory is found tobe uninhabited and 8 is assigned the following` distinctive short for designation. "Belmont` --Clovis tr3" . 10 Section 3.. The City of Fresno is designated as the conducting' 11 agency, and the governing body of said agency is hereby directed 12 to initiate reorganization proceedings in compliance with this resolution. 14 Section 4. Further proceedings shall.be initiated by the 35 conducting agency not later than. 35 days after the date of adoptioh 16 of the Commis s ion resol - u,tion ; and shall be conducted and cornpl eted 17 pursuant to required law. Proceedings and any,resolution of, 18 approval shall comply with the Commission' resolution of approval.
