WHEREAS, preliminary proceedings were initiated, by the ;City
of Fresno to annex territory generally located,near the inter-

section of Bullardand Forkner Avenues td, the City of Fresno and.
7
detach from the, North. Central Fire Protect .on. District and Kings
River Conservation District in the County of Fresno; and
WHEREAS, an application for said proposal was accepted for
10
filing by the Executive officer of this Local, Agency For ation
j
Commission; and

WHEREAS, s>a-id application was set for hearing by the Executive
i

Officer on the 24th day of .March, 1982, at the hour of 2:00 -p.mz

of said day; and

WHERE AAS , notice of the hearing of said appl i cation was duly-
16

given by mail, posting, and newspaper publication, as required by
17
law; and
18
WHEREAS, the Executive officer reviewed said ap plicati on and
19
prepared a report, including his recommendations thereon, said
24
application and .report having been presented to and considered by
21
this Commission; and

WHEREAS, this Commission, considere<4 all relevant factors and.
23
heard all interested parties wishing to speak can said applicationf
24
and
25
WHEREAS, the Commission has reviewed and. Considered. the
26
information in the Negative Declaration as provided in the Executive
27
Officer's Report duly prepared and filed, by the City of Fresno.

NOW, THEREFORE, BE IT RESOLVED that the Local Agency Formation
29
Commission of the County of Er e s n.o does HEREBY RESOLVE, DETERMI E x

AND ORDER as follows

Section 1. Said proposal is approved 'subjec to the terms and.

conditions hereinafter specified. Any resolution of the conducting

agency ordering this reorganization shall provide that Such

1. Annexation to County Waterworks Districts No 19, 23, and

25 shall be made a part of this proposal, as shown on the attached

Exhibit.

Section 2. Said territory is found to be uninhabited and
8
is assigned the following distinctive sherd form. designation.

"Bullard-Forkner ; 3 `r .

Section 3. The City of Fresno is designated as theconducting
11
agency, and the governing body of said agency is hereby directed to,,
12
initiate reorganization proceedings in complianc with this
13
resolution.

Section 6. Further proceedings shall, be initiated by the
15
conducting agency not later than 35 `'days after the data' cif adoption:
16
of the Commission resolution and shall be conducted and completed
17
pursuant to required law, Proceedings and any resolution. of
18
approval- shall comply with the Commission's resolution of approval.
19
Section 5. The restriction in Government Code Section 35010
20 1which
prohibits creation of unincorporated islands, is hereby
21
waived by the Commission..

Section. 6. The Executive Officer is hereby authorized and
23
directed to mail certified copies of this resolution as provided
24
in Section 56272 of the Government Code.
