WHEREAS, preliminary proceedings were initiated by the City off:

Fresno to annex territory generally located west of Marks Avenue

between Whitesbridge Avenue and the Sou-Ehern Pacific Railroad
(Kerman Branch) to the City of,Fresno and de :Cach from the. north

Central, Fire -ProtectionDistrict and Kings River Conservation ,c

District in the county of Fresno; and

WHEREAS, an application, for said proposal was accepted .for

filing by the Exec hive officer of this Local. Agency Formation

commission; and

WHEREAS, said application was set for hearing by the Executive
14
Officer on the 27th day of Janua:_y, 1.982, and was continued nued to

March 24, 1982-at the hour of 1,..30 p.m. J and

WHEREAS notice of the hearing. of said application was dul

by mail., postings, and newspaper publication as , required by

WHEREAS, the Executive Officer reviewed said appli cation ,and

prepared a report, including his recommendations thereon, said

application and report having been presented to and considered: by,

this Commission; and

WHEREAS,` this Commission considered all relevant -factors and

heard all interested parties wishing to speak an said applications

information in the Negative Declaration as provided in the Executive

Offieers Report duly prepared and filed by the City of Fresno. �

NOW, THEREFORE, BE IT RESOLVED that the Local: AgencyForrnatioh

Section 1. said proposal is approved 'subject to: the terms and

conditions hereinafter specifted.Any resolution ' of the conducting,
agency ordering this reor-ganization shall provide that :such

reorganization shall be subject, to the following terns and
conditions*
1. Prior to comp ,etxan Of this proposal, the City shall agree

that before any landowner in the area shall be required to extend
8
and connect to any water or sewer lines or construct curbs and gutters
g
or street improvements the City shall begin proceedings to form
14
an improvement district for stLc:h extensions and improvements; such.

agreement shall be made available to each landowner.
2. Prior to completion of this proposal. an instant aid agree
13
meet for fire protection with the North Ce.ntra,I. Fire District s hall
,

be signed by the City and District. Such agreement may also
15
provide for transfer of both fire district, station and employees
1s
to the City.

3. The proposal boundar ,=.,s and map shall be revised to
18
-exclude APN 32 e-150--a 7, 08 ; ( 45 acres ) and to include APN 458 -O Z- 9
19
(1`3 acres) . The subject proposal shall act. be 'cc pleted until
20
after completion of the Neilse�::�-Hughes �3-D proposal (RC-81-74) to
21
the east.
