(D �t� *} }..ic�S �.t�v t� ���.1*s-.,.--..».......—........r—.........,.;e.....,. , r 41 t WHEREAS.- preliminary proceedings were initiated by the City of ,5 Fresno to annex territory generally located south of Niel5en Avenue on both sides of West Avenue to the City of Fresno and 7, detach from the North Central 11i e Protection District and Kings g River Conservation District in. the County of Fresno; and g WHEREAS an application for . said proposal was accepted for 10 filing by the Executive Officer of this Local Agency Formation commission; and 32 WHEREAS, said application was set for hearing by - the Executive Officer on the 24th day of March, 1982, at the ;hour of 1; 30 pm. 14 of said -day; and 151 WHEREAS, notice of the hearing of said application, was duly 16 given by mail, posting, and newspaper publication as ,required by 3-7 law; and 18 WHEREAS, the Executive officer reviewed, said application and. -49 prepared a report, including his recommendations thereon,- said 20 application and report having' been presented to and. considered by this Commissionand 22 WHEREAS, th-is Commission, considered all relevant factors anal 23 heard all interested parties wishing to speak on said application; 24 and 'WHEREAS, the Commission has reviewed and considered. the 26 information in •the Negative Declaration as provided in the Executive 27 Of f:.cer' s Report duly prepared and filed by the City of Fresno. 28 NOW, THEREVORE, BE IT RESOLVED that the Local Agency Formation 29 Commission of the County of Fresno does HEREBY RESOLVE, DETERMINE, AND ORDER. as follows 31 Section 1,. Said proposal .5s approves, subject to the terns and 32 conditions hereinafter specified. Any resolution of the conducting Wry a� FRIrSN y I � agency ordering this reorganization shall prova.de that such 2 reorganization shall be subject to the following terms and. 3 conditions, 41 1. Prior to completion of this proposal, the City shall agree 5 that before any landowner in the area shall be required to extend 5 and connect any Water or sewer lines :or construct curbs and cutters f 7 ' or street improveznents , the City shell begin proceedings to form g an improvement districtfor such extensions and.. improvements. Such 9 agreement ` shall be made available to each. landowner. 10 2. Prior to completion of this -proposal, an instant aid agreement' for fire protection with the North Central Fire Dis tri�c-t 12 shall be signed by the City and District. Such agreement may also 13 provide for transfer ' oz both fire district station and employees la to the City. i 3 Section 2. Said territory is found to be uninhabited and 16 is assigned the following distinctive short form designation. 17 Ti N'i.el s en-Tei lman r 1� Section'3. The. City of Fresno is designated as the conducting 19 agency, and the 'governing body of said ,agency is hereby directed to 20 initiate reorganization proceedings in compliance with this 21 resolution. 22 Section 4. Further proceedings, shall be initiated by the 23 conducting agency, not later than 35 days after the .-date of adoption { 24 of the ComMissi.an resolution and shall be conducted and completed E {4(} 25 pursuant to requiredlaw• Proceedings and any resolution of- 2o approval .shall comply with the Commission's resolution of approval.. 27 Section_ 5.
