HomeMy WebLinkAboutResolution - City Council - 82-120 - 1982-03-16w t • RESOLUTION NO. 82-120 • Ed Bielicki RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO RECOMMENDING TO THE STATE ASSEMBLY COMMITTEE ON HOUSING AND COMMUNITY DEVEL- OPMENT THAT CHANGES BE MADE TO THE CALI- FORNIA GOVERNMENT CODE AFFECTING ANNEXA- TIONS AND DISTRICT REORGANIZATIONS. WHEREAS, the State Assembly Committee on Housing and Community Development is considering changes to the Califor- nia Government Code affecting annexations and district re- organizations; and WHEREAS, many of the provisions of State annexation law have caused undue time delays and costs to both local govern- ment and private industry; and WHEREAS, informal discussions involving Assemblyman Costa, members of his staff, City representatives, and representatives of the local building industry have identified the following areas of concern: 1. The provisions of Government Code Sections 35038 and 56045 specify that if an area proposed for annexation contains 12 or more registered voters, it is consid- ered to be inhabited and must be subjected to the possibility of ratification through an election. 2. The inhabited annexation and district reorganization process permits a minority of residents in the area to require that an election be held in order to pro- ceed with the proposed annexation or reorganization. 3. The costs and time delays of an election are signi- ficant. As a result, the City and private developers must either face the problems and costs of elections, or resort, when possible, to a series of smaller annexations which are costly, time consuming, and sometimes lead to irregular corporate boundaries; and WHEREAS, a solution to this problem would be to change the number of registered voters in an inhabited annexation from 12 to 50. Page 1 of 2 \4�_ /120 NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Fresno hereby recommends to the State Assembly Com- mittee on Housing and Community Development the following: That California Government Code Sections 35038 and 56045 be amended to change the definition of an inhabited annexation or district reorgan- ization from the current number of 12 registered voters to a more reasonable figure of 50.
