RESOLUTION NO. 82-108
RESOLUTION OF THE COUNCIL OF THE CITY OF
FRESNO APPLYING TO THE FRESNO LOCAL AGENCY
FORMATION COMMISSION IN THE MATTER OF THE
PROPOSED LAUREL-MINNEWAWA NO. 1 DISTRICT
REORGANIZATION, INCLUDING THE DETACHMENT
OF CERTAIN TERRITORY CONSISTING OF 7.79
ACRES FROM THE MID VALLEY FIRE PROTECT-
ION DISTRICT AND THE KINGS RIVER CONSERVA-
TION DISTRICT, AND ANNEXATION OF SAID TER-
RITORY TO THE CITY OF FRESNO.
WHEREAS, this proposal is made pursuant to the District
Reorganization Act of 1965 contained in Division 1 of Title
6 (commencing with Section 56000) of the California Govern-
ment Code; and
WHEREAS, the nature of the proposed change is a reorgan-
ization consisting of the detachment of certain territory
consisting of 7.79 acres and hereinafter called the "subject
territory" from the Mid Valley Fire Protection District
and the Kings River Conservation District, and annexation of
the same territory to the City of Fresno; and
WHEREAS, no other counties, cities, or districts are
affected; and
WHEREAS, the proposed reorganization is uninhabited,
is described in Exhibit "A" and graphically depicted in
Exhibit "B"; and
WHEREAS, the Master Service Delivery Plan, adopted by
the Council on November 13, 1979, prepared in accordance
with Government Code Section 35102, provides information
for the City of Fresno's plans and policies for the pro-
vision of services in the metropolitan area; and
WHEREAS, pursuant to Resolution No. 80-172, the Council
has approved the implementation of the Master Service Delivery
Plan; and
WHEREAS, the Master Service Delivery Plan specifies City
plans and policies for the provision of services to the sub-
ject territory; and

WHEREAS, review and analysis of Environmental Assess-
ment No. 3174, relating to the Master Service Delivery
Plan has resulted in the filing of a Negative Declaration
by the Director of Planning and Inspection; and
WHEREAS, no new districts are proposed to be formed
by this reorganization; and
WHEREAS, the Fresno County Assessor's roll will be
used for the purpose of levying any assessments or taxes on
the subject territory; and
WHEREAS, the subject territory proposed to be annexed
to the City of Fresno will be exempted from taxation for
payment of principal or interest, or any other amounts which
shall become due on account of any outstanding bonded indebt-
edness incurred by the City prior to the effective date of
such annexation, and upon completion of this reorganization
proposal, the subject territory will be included in Municipal
Bonded Area "D" and will not be taxed for any existing bonded
indebtedness or contractual obligations; and
WHEREAS, the reasons for this proposal are stated as
follows:
1. Annexation of the subject territory to the
City of Fresno will result in improved land
use planning. All private development con-
trols of the City will apply, following re-
organization.
2. The subject territory is within the City of
Fresno's Sphere of Influence.
3. Two property owners within the project area
have requested annexation to the City.
4. It is advantageous for the subject territory to
be a part of the City.

NOW, THEREFORE, BE IT RESOLVED that the Council of the
City of Fresno hereby requests that proceedings be taken by
the Fresno Local Agency Formation Commission for the herein
proposed Laurel-Minnewawa No. 1 District Reorganization,
including the detachment of the subject territory, consist-
ing of 7.79 acres from the Mid Valley Fire Protection
District and the Kings River Conservation District, and
annexation of the same territory to the City of Fresno; and
BE IT FURTHER RESOLVED the Council of the City of
Fresno finds Environmental Assessment No. 3174 is the con-
trolling environmental document for this annexation pro-
posal, such environmental assessment has been completed
in compliance with the California Environmental Quality
Act and the State Guidelines, and the Council has reviewed
and considered the information contained in such environ-
mental assessment prior to the approval of the initiation
of this annexation proposal and finds there is no poss-
ibility such proposal may have a significant effect on
the environment.

DISTRICT REORGANIZATION
Area to be Detached from the Mid Valley Fire Protection District, the Kings
River Conservation District, and Annexed to the City of Fresno.
Consisting of portions of Lots 35 and 36 of Easterby Rancho, lying in Section
5, 14/21, M.D.B.6M.
BEGINNING at a point on the South line Of Lot 35, of Easterby Rancho, as said
lot is shown on the Map thereof, filed in the Office of the County Recorder
June 24, 1880 and recorded in Volume 2 of Plats at page 6, Fresno County
Records, which is 1006.50 feet West of the Intersection of the center line of
Fancher Creek with the South line of Lot 34, of said Easterby Rancho, being
also, 195.40 feet East of the Southwest corner of said Lot 35, being also, a
point on the existing City Limits of the City of Fresno; thence Northerly,
along a line which is parallel with and 195.40 feet East of the West line of said
Lot 35, being also, along the existing City Limits of said City, a distance of
482.00 feet; thence Westerly, being also, along the existing City Limits of
said City, a distance of 231.20 feet, into Lot 36 of said Easterby Rancho;
thence Northerly, being also, along the existing City Limits of said City, a
distance of 140.00 feet; thence North 55*22100" West, along the existing
City Limits of said City, a distance Of 80.00 feet; thence North 83"32'00" West
along the existing City Limits of said City, a distance of 86.00 feet; thence
South 73"52'00" West, along the existing City Limits of said City, a distance
of 171.00 feet; thence South 73"22'00" West, along the existing City Limits of
said City, a distance of 331.60 feet, to the intersection with the West line
of the Southeast Quarter of Section 5, Township 14 South, Range 21 East, Mount
Diablo Base and Meridian, as said Section is shown on the United States Govern-
ment Township Plats, at a point which is 526.00 feet North of the Southwest
corner of the North Half of the Southeast Quarter of said Section 5; thence
Southerly, along the West line of the Southeast Quarter of said Section 5, a
distance of 240.00 feet, to a point which is 286.00 feet North of the South-
west corner of the North Half of the Southeast Quarter of said Section 5;
thence Easterly, along a line which is parallel with and 286.00 feet North of
the South line of said Lot 36, to a point which is 95.00 feet West of the East
line of said Lot 36; thence Southerly, along a line which is parallel with and
95.00 feet West of the East line of said Lot 36, a distance of 286.00 feet, to
