RESOLUTION NO. 82-107
RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO
APPLYING TO THE FRESNO LOCAL AGENCY FORMATION
COMMISSION IN THE MATTER OF THE PROPOSED BULLARD-
MAROA NO. 3 DISTRICT REORGANIZATION, INCLUDING
THE DETACHMENT OF CERTAIN TERRITORY CONSISTING
OF 15.82 ACRES FROM THE NORTH CENTRAL FIRE PRO-
TECTION DISTRICT AND THE KINGS RIVER CONSERVATION
DISTRICT, AND ANNEXATION OF SAID TERRITORY TO THE
CITY OF FRESNO.
WHEREAS, this proposal is made pursuant to the District
Reorganization Act of 1965 contained in Division 1 of Title
6 (commencing with Section 56000) of the California Govern-
ment Code; and
WHEREAS, the nature of the proposed change is a reorgan-
ization consisting of the detachment of certain territory
consisting of 15.82 acres and hereinafter called the "subject
territory" from the North Central Fire Protection District
and the Kings River Conservation District, and annexation of
the same territory to the City of Fresno; and
WHEREAS, the owners of all the land within said -er-
ritory have requested and consented to such annexation;
and
WHEREAS, no other counties, cities, or districts are
affected; and
WHEREAS, the proposed reorganization is inhabited,
is described in Exhibit "A" and graphically depicted in
Exhibit "B"; and
WHEREAS, the Master Service Delivery Plan, adopted by
the Council on November 13, 1979, prepared in accordance
with Government Code Section 35102, provides information
for the City of Fresno's plans and policies for the pro-
vision of services in the metropolitan area; and
WHEREAS, pursuant to Resolution No. 80-172, the Council
has approved the implementation of the Master Service Delivery
Plan; and
WHEREAS, the Master Service Delivery Plan specifies City
Plans and policies for the provision of services to the sub-
ject territory; and

WHEREAS, review and analysis of Environmental Assess-
ment No. 3174, relating to the Master Service Delivery
Plan has resulted in the filing of a Negative Declaration
by the Director of Planning and Inspection; and
WHEREAS, no new districts are proposed to be formed
by this reorganization; and
WHEREAS, the Fresno County Assessor's roll will be
used for the purpose of levying any assessments or taxes on
the subject territory; and
WHEREAS, the subject territory proposed to be annexed
to the City of Fresno will be exempted from taxation for
payment of principal or interest, or any other amounts which
shall become due on account of any outstanding bonded indebt-
edness incurred by the City prior to the effective date of
such annexation, and upon completion of this reorganization
proposal, the subject territory will be included in Municipal
Bonded Area "D" and will not be taxed for any existing bonded
indebtedness or contractual obligations; and

City of Fresno will result in improved land
use planning. All private development con-
trols of the City will apply, following re-
organization.
2. The subject territory is within the City of
Fresno's Sphere of Influence.
3. All of the property owners within the project

of Fresno.
4. It is advantageous for the subject territory to
be a part of the City.

NOW, THEREFORE, BE IT RESOLVED that the Council of the
City of Fresno hereby requests that proceedings be taken by
the Fresno Local Agency Formation Commission for the herein
proposed Bullard-Maroa No. 3 District Reorganization, includ-
ing the detachment of the subject territory, consisting of
15.82 acres from the North Central Fire Protection
District and the Kings River Conservation District, and
annexation of the same territory to the City of Fresno; and
BE IT FURTHER RESOLVED the Council's application include
a request for approval ar�� authorization from the Fresno
Local Agency Formation Commission for the Council to annex
the subject territory without notice and hearing or an
election.
BE IT FURTHER RESOLVED the Council of the City of
Fresno finds Environmental Assessment No. 3174 is the con-
trolling environmental document for this annexation pro-
posal, such environmental assessment has been completed
in compliance with the California Environmental Quality
Act and the State Guidelines, and the Council has reviewed
and considered the information contained in such environ-
mental assessment prior to the approval of the initiation
of this annexation proposal and finds there is no poss-
ibility such proposal may have a significant effect on
the environment.

DISTRICT REORGANIZATION
Part I
Area to be Detached from the North Central Fire Protection District, the
Kings River Conservation District, and Annexed to the City of Fresno.
Consisting of Lot 5 and a portion of Lot 6 of California Poultry Farm, lying
in the Northwest Quarter of Section 9, 13/20, M.D.B.6M.
BEGINNING at the intersection of the Easterly production of the South line of
Lot 5 of California Poultry Farm, as said lot is shown on the Map thereof,
filed in the Office of the County Recorder May 2, 1904 and recorded in Volume
2 of Record of Surveys at page 829 Fresno County Records, with the West line
of the Northeast Quarter of Section 9, Township 13 South, Range 20 East, Mount
Diablo Base and Meridian, as said Section is shown on the United States Govern-
ment Township Plats, being also, a point on the existing City Limits of the
City of Fresno; thence Northerly, along the West line of the Northeast Quarter
of said Section 9, being also, along the existing City Limits of the City of
Fresno, to the North Quarter corner of said Section 9; thence Westerly, along
the North line of the Northwest Quarter of said Section 9, to the intersection
with a line which is parallel with and 15.00 feet East of the. West line of the
Northeast Quarter of Lot 6, of said California Poultry Farm; thence Southerly,
along a line which is parallel with and 15.00 feet East of the West line of

BEGINNING at the intersection of the North line of Lot 64 of California Poultry
Farm, as said lot is shown on the Map thereof, filed in the Office of the County
Recorder May 2, 1904 and recorded in Volume 2 of Record of Surveys at page 82,
Fresno County Records, with the center line of North Colonial Avenue, being also,
a point on the existing City Limits of the City of Fresno; thence Southerly,
along the center line of said North Colonial Avenue, being also, along the
existing City Limits of said City, to the intersection with a line which is
parallel with and 310.00 feet North of the South line of said Lot 64; thence
Easterly, along a line which is parallel with and 310.00 feet North of the South
line of said Lot 64, a distance of 180.00 feet, to the intersection with the
East line of said Lot 64; thence Northerly, along the East line of said Lot 64,
a distance of 40.00 feet; thence Easterly, across Lots 65 and 66, of said Cali-
