RESOLUTION ORDERING THE VACATION OF
THE RELINQUISHMENT OF VEHICULAR ACCESS RIGHTS
ON PARCEL "M" OF PARCEL MAP 79-50
WHEREAS, pursuant to Resolution of Intention No. 813-D,
on file in the Office of the City Clerk, a public hearing
was held on the 2nd day of March, 1982, at a regular meeting
of the Council of the City of Fresno, County of Fresno,
State of California, at which time and place evidence was
heard for and against the vacation of the hereinafter de-
scribed relinquishment of vehicular access rights, situated
within the City of Fresno; and
WHEREAS, the City Traffic Engineer has reviewed the
proposed vacation action and determined that it will have no
adverse effect upon traffic circulation; and
WHEREAS, the Council finds and determines that the
relinquishment of vehicular access rights proposed to be
vacated are not useful as bicycle paths or routes; and
WHEREAS, findings of Environmental Assessment No. 4379
indicate that the proposed vacation action will have no
significant effect upon the environment; and
WHEREAS, the Council of the City of Fresno finds from
all evidence submitted that the relinquishment of vehicular
access rights is unnecessary for present and prospective
public use; and
WHEREAS, this action is being taken pursuant to the
provisions of the Public Streets, Highways, and Service
Easements Vacation Law, being Sections 8300-8363, Part 3,
Division 9 of the Streets and Highways Code of the State of
California.
NOW, THEREFORE, BE IT RESOLVED:
1. That public interest and convenience require, and
it is hereby ordered, that as contemplated by Resolution of
intention No. 813-D, adopted by the Council of the City of

Fresno on the 9th day of February, 1982, the hereinafter
described relinquishment of vehicular access rights situated
in the City of Fresno be and the same is vacated.
2. The relinquishment of vehicular access rights to
be vacated are described as follows:
The relinquishment of vehicular access rights on
Parcel "M" of Parcel Map 79-50 (Northwest corner
of First Street and Magill Avenue).
For further particulars as to the proposed vacation,
reference is hereby made to the attached Exhibit "A".
3. The City Clerk of the City of Fresno shall certify
to the passage of this Resolution and shall file a certified
copy, attested by the Clerk under the seal of the City of
Fresno, in the Office of the City Clerk of the City of
Fresno, State of California.
9. That this vacation shall become effective on the
date of recordation of this Resolution
