HomeMy WebLinkAboutResolution - City Council - 82-104 - 1982-03-02+ • • Public Work., 692t�:� FpureFnh' File No. 7615 city. r. � �T 03 a tma No F'►OoC RESOLUTION NO. 82-104 bo,,K7957p,,f 3(Q o F to t:RF �**' ROOM l hi RESOLUTION ORDERING THE VACATION OF A PORTION OF INYO STREET BETWEEN "P" STREET AND SANTA FE AVENUE WHEREAS, pursuant to Resolution of Intention No. 811-D, on file in the Office of the City Clerk, a public hearing was held on the 2nd day of March, 1982, at a regular meeting of the Council of the City of Fresno, County of Fresno, State of California, at which time and place evi- dence was heard for and against the vacation of the herein- after described rights of way or parts thereof, situated within the City of Fresno; and WHEREAS, the City Traffic Engineer has reviewed the proposed vacation action and determined that it will have no adverse effect upon traffic circulation; and WHEREAS, the Council finds and determines that the rights of way or parts thereof proposed to be vacated are not useful as bicycle paths or routes; and WHEREAS, findings of Environmental Assessment No. 4343 indicate that the proposed vacation will have no significant effect upon the environment; and WHEREAS, the Council of the City of Fresno finds from all evidence submitted that such rights of way or parts thereof are unnecessary for present and prospective public street purposes; and WHEREAS, this action is being taken pursuant to the provisions of the Public Streets, Highways, and Service Easements Vacation Law, being Sections 8300-8363, Part 3, Division 9 of the Streets and Highways Code of the State of California. NOW, THEREFORE, BE IT RESOLVED: 1• That public interest apd convenience require, and OEpu it is hereby ordered, that as contemplatL�{4ERb +Resolution of Intention No. 811-D, adopted by the Council of the City of RECORDED IN OFFICIAL RECORDS OF iRESNO COUNTY, ULIFgW IAA' AUG 181982 JIVE Q WFEE �-/off • • BOOK 1957pe&E 370 -2- Fresno on the 9th day of February, 1982, the hereinafter described rights of way or parts thereof situated in the City of Fresno be and the same are hereby closed, vacated and abandoned for public purposes. 2. The rights of way or parts thereof to be vacated are described as follows: The Southerly 6 feet of Inyo Street between "P" Street and Santa Fe Avenue. For further particulars as to the proposed vacation, reference is hereby made to the attached Exhibit "A". 3. The City of Fresno reserves and excepts from the vacation the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers, water mains, and storm drains and appurtenant structures in, upon, and over the rights of way or parts thereof to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the transportation or dis- tribution of electric energy, petroleum and its products, ammonia, water, and incidental purposes, including access to protect such works from all hazards in, upon, and over the rights of way or parts thereof to be vacated. 4. That all proceedings for the vacation of such rights of way or parts thereof are intended to be and shall be taken subject to the foregoing reservations and exceptions. 5. The City Clerk of the City of Fresno shall certify to the passage of this Resolution and shall file a certified copy, attested by the Clerk under the seal of the City of Fresno, in the Office of the City Clerk of the City of Fresno, State of California. • 0 60n47J57ptu371 -3- 6.
