RESOLUTION NO. 82-100
A RESOLUTION OF THE COUNCIL OF THE CITY OF
FRESNO, CALIFORNIA, RELATING TO THE ABATE-
MENT OF WEEDS, RUBBISH, REFUSE, AND DIRT
FROM PRIVATE PROPERTY AND STREETS.
IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF FRESNO:
SECTION 1. The parcels of property and adjacent abutting parkways,
streets, and sidewalks located and described as set forth in Exhibit "A",
on file with the City Clerk and incorporated herein by reference, contain
either noxious or dangerous weeds of a seasonal and recurrent nature, or
rubbish, refuse, concrete, asphalt, or mounds of dirt, and such items are
hereby declared seasonal and recurrent public nuisances in need of abate-
ment by destruction, leveling, or removal.
SECTION 2. The duty of the City Clerk under Government Code Section
39567.1 is hereby delegated to the Fire Marshal. Pursuant thereto, the
Fire Marshal of the City of Fresno is directed to mail written notice of
the proposed abatement to each person to wham such property .is assessed
in the last equalized assessment roll, in compliance with the form of, and
at the time specified in Article 2, Chapter 13, Part 2, Division 3, of
Title 4, of the Government Code of the State of California (Section 39560
et seq.)
SECTION 3. Unless sooner abated by the owners or occupiers of said
property, or other persons, the City of Fresno, after a hearing of any
objections of the property owners of the parcels, will abate said public
nuisances pursuant to the Government Code, and will assess the property for
the cost of said abatement. The hearing to consider any objections of the
property owners is hereby set at 2:00 p.m., on Tuesday, April 20, 1982, in
the Council Chamber, City Hall, 2326 Fresno Street, Fresno, California.
